There was just a commercial for the 11pm news about a 15 year old that could be facing felony charges for having pictures of other naked 15 year old and they are saying its "child porn"

Its this big "sexting" bust that is trying to go on, but really? With almost every 13 year old having a cell phone with a camera, this seems like its going to be a larger and larger problem. Kids getting "child porn" charges against them before they are 18 because their gf sends them a naked pic thru txt messaging?

Not sure how I stand on this, I can see parents trying to blame mobile providers. I know if I was 15 now a days, I would be trying to get girls to send me pics all the time

If a 15 year old webcams himself jacking off and he is the only one that views it and possesses the video is he in possession of CP? According to these laws he might be. And of course taking that logic to the next level, by jacking himself off he's committing child molestation

Personally, I believe the cut off should be 18, just as it is for producing content. but its going to become a bigger and bigger issue

good point, an image that is accidentally viewed on a webpage ends up being cached on your hard drive, and makes you technically in possession of every image that casually passed by on your screen as you were surfing the web

so back to the topic, the op's concern was about young kids having pornagraphic pictures of other young kids, and my comment was directed to that.

what's the cut off? sure, as a teen, i had polaroids of a girlfriend or 2 naked, i didn't thin anything of it. it was a turn on. they were consentual, but we were all underage.

so my rhetorical question of what's the age cutoff was more an attempt to create dialogue.

If someone sent you kiddy porn (even another minor) you should be OK, unless you collect it, request it, etc.
If you then send it to someone else you would be distributing kiddy porn.
If you shot a pic of yourself, well that should be null.
If you send that to someone else you are distributing kiddy porn.

Just my views. Also no I do not blame technology. Kids could of done it with a polaroid or other medium in the past. They just need to be brought up to speed that the world does not revolve around them.

It is a slippery slope. If you are a 15 year old guy and your 15 year old girlfriend gets naked for you, no problem. But if she sends you a naked picture of herself, now it is illegal. Obviously you don't want naked pictures of kids floating around out there, but to charge kids as sex offenders and potentially fuck up their lives because they were/are young and dumb is pretty stupid too.

Don't care -15 yr's old is still 15 and they should be learning other things then get involved with sex. There is a reason why the law states that, and just because another person the same age has pictures or not - it's still way to young to be getting involved in sex. The girl who had the pictures taken did not realize nor have the ability to realize what she was doing and that the pictures were wrong. This is also how boys learn to mistreat women and see girls as only sex objects. Sure at that age we all have desires and "love" - but it's immature and can lead to future problems if not handled correctly.

They should change rules on possession. Possession of non-commercial solo pictures featuring 14-18 year olds (= camwhore pics) should not be illegal. Just distribution and commercial exploitation of them.

If a teen girl shows herself naked online, she's a moron, but she's most likely not the victim of abuse. Those who see it have a pretty good chance of not even knowing that she is underage, so prosecuting them is utterly asinine.

If you disagree with this, keep in mind that chances of you unknowingly having come across pictures like that are roughly 100%. Dating ads, "hot camgirl" threads on forums, etc. - they all regularly contain girls under 18.

"Protecting" teens from consensual sex and sex-related activities is utterly idiotic. It hasn't worked in the past, it isn't working now, and it will never work. Unless you monitor them 24/7, teens in the 14-18 age range will experiment with sex. There is no way to stop that, they're biologically wired that way.

The only thing locking them up for it will achieve is ruining their lives - something only the stupidest bible thumpers could want.

Want to protect teens? Educate them and tackle actual abuse. Protect them from predators, instead of trying to protect them from normal natural impulses.

There's another issue which hasn't been brought up in this thread: as well as being charged with possession of CP, they may also be required to register [for life] as a sex offender. Now THAT is definitely going over the top when it's simply a 15yo girl sending a naked pic to her b/f.
