New Jersey Man Charged with Obscenity Violations

A Jersey City, N.J., producer has been charged by a federal grand jury in Newark, N.J. with distributing obscene DVDs through the mails.

Barry Goldman, 58, was charged with eight counts of using the mails to deliver DVDs containing allegedly obscene films from Jersey City to addresses in Montana and Virginia. The indictment seeks forfeiture of the proceeds from the sale of the DVDs, along with property used in producing the DVDs, all web sites operated by Goldman and other property.

If convicted, Goldman faces a maximum penalty of five years in prison and a fine of $250,000 on each of the eight counts charged in the indictment.

An indictment is merely an accusation. All defendants are presumed innocent of the charges and it is the government?s burden to prove a defendant?s guilt beyond a reasonable doubt at trial.

The case is being prosecuted by Trial Attorney Bonnie Hannan of the Criminal Division?s Obscenity Prosecution Task Force.

Investigation of the case was conducted by the FBI?s Adult Obscenity Squad based in the Washington, D.C. Field Office.

Meanwhile Obama's government has stolen more money from the people than all previous US governments combined..

And, NJ is bankrupt and rudderless.

Pleasurepays 07-26-2009 02:30 PM

This would never happen under a Democratic President!

Vote Obama for Hope and Change

er... wait...

DonovanTrent 07-26-2009 02:43 PM

Let's get real for a second... it doesn't matter who's President, sending stuff like that through the mail is still going to get your ass in a sling.

PurrrsianPussyKat 07-26-2009 03:07 PM

mikesouth 07-26-2009 04:33 PM

I have always said that deomocrats or republicans either one will sell us out in a heartbeat if they see one iota ofpolitical gain in it. It isnt about ideology its about pandering for votes.

Only the Libertarians publicly state we have the right to do what we do.

If you think dems or reps are your friends you are living in a dream

I do think its hilarious you guys are blaming Obama for a guy mailing videos of child endangerment type of porn. While I understand the notion you insinuate, you surely detract from the actual topic which should be... is porn okay to produce if you risk the life of a child in the womb?

in the words of Paul Harvey and here is the rest of the story. The indictment came down August 2008.

I'm not surprised. Kind of figured it was something that was already in the pipeline.

I suppose that all the GFY republicans will be rather disappointed though.

your messiah, black jesus.... the Constitutional Lawyer had and has the power to stop all this or even tear down the "Obscenity Task Force".... but he's not going to do something that's going to cost him votes.

Obama is at the helm... its Obama's Department of Justice. Not Bush's

Look, I'm all for letting people buy what they want to buy, etc. But Mike's right, unless there's a Libertarian in office, we're going to have situations like this, and people can either play it smart or play it stupid. This guy chose to play it stupid. Or maybe they don't have UPS or FedEx where he lives?

The topic, has nothing to do with Obama, the fact you keep wanting to make it so proves you have no real side to debate and simply want to bash Obama.

Hogtieing girls for periods of time and forcing them to lie on their stomach, doesnt sound like a good idea, but go ahead, keep bring up divisive topics like abortion and Obama and avoid an actual discussion. Filming bondage on pregnant women, involving tieing them up and forcing them to lay on stomach and then mailing it out, is walking a line most would stear clear of.

Come on get real. No one in their right mind expected the man to come out and defend porn.

A lot of us were counting on some Clinton administration style benign neglect however and, as of now, it looks like that might still be in the cards :thumbsup

As for the topic, the pregnant one is a bit controversial, because it is implicating an unwilling soon to be born child ... He could suffer sequels from this.

Other titles ... to each is own .. You want to do it, you want to watch it ... should not even be of concern to the authorities :2 cents:

No kidding. They'll spend millions to go court and then more money to lock him up. All because he shot an adult video with consenting adults?

Motherfucker.. after typing that, I thought how painful a mousetrap would be on my dick..

pocketkangaroo 07-26-2009 09:17 PM

If it was about the well being of the child, it should be child endangerment or whatever law prohibits people from doing danger to an unborn child.

The charge is obscenity and that's what should be judged. It's sad as a nation that we target free speech like this. Hopefully the ACLU or someone will take the case and win.

DonovanTrent 07-26-2009 09:46 PM

I agree that obscenity prosecutions are ridiculous. But when you're standing in a swamp, you can cry all you want that there should be no mud, but you're still standing in a swamp. that's reality.

Best thing to do, don't step in the swamp.

If he had Lee Noga's zip code list none of this would have happened...

NKYKev 07-27-2009 05:05 PM

I am seeing several stories saying only 3 movies were charged in the original indictment, and they all seem to say it is the "Porn Star" video that was charged. Have they added the "Porn Store" video? It seems the "Porn Store" video contains more extreme content; the "Porn Star" type of content can be found on almost any BDSM site.

pornlaw 07-27-2009 06:27 PM

Attorney General Eric Holder is no friend of this industry. And having David Ogden in there as the Deputy Attorney General is no benefit either.

Many thought having a former porn attorney would catch us a break, but it might result in just the opposite effect.

As an attorney I hate dealing with either defense or plaintiff counsel that have now done a flip-flop. They are usually more difficult to deal with since they know what being on the other side is like.

Even though this indictment came down under Bush, it doesnt appear that the Holder/Ogden team is going to be soft on porn.

I still think the bellweather case is John Stagliano's case. If that starts moving forward I think that will signal the true intentions of this administration.

This current case against Goldman is still somewhat fringe and is against a smaller producer. Not exactly a battle when it comes to prosecutions.

:2 cents:
