DOJ Obscenity Task Force Brings indictment Against NJ Porner

Barry Goldman, 58, was charged with eight counts of using the mails to deliver DVDs containing allegedly obscene films from Jersey City to addresses in Montana and Virginia. The indictment seeks forfeiture of the proceeds from the sale of the DVDs, along with property used in producing the DVDs, all web sites operated by Goldman and other property. If convicted, Goldman faces a maximum penalty of five years in prison and a fine of $250,000 on each of the eight counts charged in the indictment. An indictment is merely an accusation. All defendants are presumed innocent of the charges and it is the government?s burden to prove a defendant?s guilt beyond a reasonable doubt at trial. The case is being prosecuted by Trial Attorney Bonnie Hannan of the Criminal Division?s Obscenity Prosecution Task Force. Investigation of the case was conducted by the FBI?s Adult Obscenity Squad based in the Washington, D.C. Field Office. anyone know what kind of videos this guy was making and selling? If it was about the well being of the child, it should be child endangerment or whatever law prohibits people from doing danger to an unborn child.
The charge is obscenity and that's what should be judged. It's sad as a nation that we target free speech like this. Hopefully the ACLU or someone will take the case and win. |

Attorney General Eric Holder is no friend of this industry. And having David Ogden in there as the Deputy Attorney General is no benefit either.
Many thought having a former porn attorney would catch us a break, but it might result in just the opposite effect. As an attorney I hate dealing with either defense or plaintiff counsel that have now done a flip-flop. They are usually more difficult to deal with since they know what being on the other side is like. Even though this indictment came down under Bush, it doesnt appear that the Holder/Ogden team is going to be soft on porn. I still think the bellweather case is John Stagliano's case. If that starts moving forward I think that will signal the true intentions of this administration. This current case against Goldman is still somewhat fringe and is against a smaller producer. Not exactly a battle when it comes to prosecutions. :2 cents: |
