you don't need to know how to do that. Any site with, say, 100,000 uniques a day could kill almost any site in the net in a legal (and shady) way. The DMCA is pretty clear on these things and they seem to be following it. If you want it taken down, you can be nice about it or you can complain and scream. Either way, your content will come down but will take longer. He seemed to be offering you a faster way to get it taken down and was pretty nice about it too.

Not that it matters to me but neither would probably do any good. As others have said they are abiding by the law so they won't be shutdown. Well they probably aren't considering the owners of those sites are likely paying people to upload pirated content but that's not easily proven. What gets me is 90% or more of the content on the "illegal tubes" is all pirated stuff. Seems kind of strange courts don't seem to get what's going on or maybe they just don't care.

Maybe you guys are just going at this the wrong way. The DMCA might be working to their advantage. However, If it is indeed true that Brazzers is running these tubes and then using them to feed their own pet projects while doing substantial harm to their competition at the same time, then it might be wiser to go at them on the basis that they are involved in a MAJOR organizational conflict of interest. Unlike Google, who can actually argue that their company isn't greatly benefiting from YouTube, I doubt these guys can say that. In fact, it seems pretty obvious that they ARE benefiting greatly if all of their "sponsors" are actually owned by Brazzers too, which it appears that they are.

Joe, I wholeheartedly support your effort to stop people from infringing on your content copyrights.

As for licensing to PornHub, perhaps somewhere in the wording of the license you have grounds for terminating their license. Many content licenses put limits on the specific number of pix, or length of clips, which may be used for promotion in a non-members area.

Also, I'm not sure if you are aware, but other Tube sites can embed Pornhub videos on their own sites. Obviously that exacerbates the situation, which is not good for you (ideally, that is a loophole you can use to cancel their license, such as you were unaware that Pornhub was allowing your content to be used on sites other than their own - therefore, they should pay you for all of the other sites your content appears on or have their license terminated).

Otherwise, I know it's not the best option, but perhaps you could refund the money they paid for their license, and then terminate the license.

While I agree with you, the DMCA protects them fully and what they're doing is legal so long as they take it down. I know it sucks, but you can blame the people who put the safe harbour clause in the DMCA for that.

Didn't know the copyright laws had changed. Someone steals one pic or video and has no release or 2257 paperwork ..seems like its fun for the attorneys and alot of money for you. Do you any of you know how easy it is to win a copyright lawsuite? Its easier than prosecuting someone who just robbed your house right in front of you in broad daylight.
