Question for the GFY, Xbox has "X" TradeMarked ?
 
I was just getting ready to register a domain name for a new pay site out of Vegas and I didn't want to register a trademarked word again, as many of you had subjected is not good, as I did with "playmate"... It looks as if Microsoft "xbox" has a trademark for the letter "X" does this mean we are all fucked if we use the letters X, XX or XXX In our domain name, as I was by using "playmates". Any opinions on this????

Some time ago my lawyer explained to me that a trademark is just that - a mark, graphic, logo, etc. Not simply a word or phrase. At least, that's what I recall.

i once got a c&d and threat of a lawsuit for for diluting a famous trademark... for owning WXYZ.com (.net and .org were registered, .com wasn't)

apparently, some tv station in detriot has them as call letters, and trademarked them...

had it for like a year, as soon as I started redirecting the domain to a sponsor, I got the C&D and a phone call from some Çunt lawyer yelling at me on the phone like some 2 year old.

I eventually gave it up.. couldn't be bothered trying to fight for it.

It all depends on how much shit you want to put up with. I am not an attorney, but from what I know a trademark would only prevent you from using X-whatever in their marketplace and where the public might be confused or duped as regard to which is which. That doesn't seem likely here.

Do you want to ignore them and then possibly fight them? I suspect their pockets will go much deeper if push comes to shove, so you might either want to give up because they will run out of money first, or let them damage you and then hire an attorney to try to get something out of THEIR deep pockets.

You *can* trademark a name... but I'd doubt that Gates did the letter X... He'd have to go more specific and do Xbox. Staying so generic as to trademark a single letter would have them in court constantly!

And in this case, IF he did the letter 'X', it would only be applicable to one area such as the game/ So there would be no conflicting use of the letter in another area. Porn and electronics aren't the same area insofar as trademarks go.

Just like thehun nails anyone using 'hun' in their domains and makes any sites with adult content but couldn't do a thing if the hun name was incorporated into a site pertaining to say, the huns bookstore etc.
