I kid you not. Our entire site including members area was just down for over 24 hours because of this scumbag. And if we hadn't had the site mirrored on Webair, just ready to switch DNS, it would have been much longer.

He sent a DMCA to our host claiming that he'd designed the site and that we hadn't paid for it. (It was designed by Webinc, years ago, and fully paid for)

LOL, and now he just emailed the following (anonymously, using our contact form): keep fucking with me and your friends, and you will go down again you asshole!. this is for threatning me in the forums. Also you have no clue who I am, your photos are all wrong!. you have the wrong person so it\'s funny and I\'m laughing at you!. Trust me, keep it up and poof!! again your gone.

Isn't that what the law specifically requires? Get a DMCA, take the content offline. Get a counter to the DMCA, put it back up and let the two parties duke it out in court.

The OCILLA provides a way to counter-claim. An ISP dropping a site due to a DESIGN DCMA without properly contacting the client to even discuss it is like Escobar pissing his pants by getting caught by a mall security guard.

That's if the DMCA actually has any merit or meat - if the owner states specifically that this is bullshit and agrees to not hold the ISP liable, the ISP will generally be happy with forwarding the request onto their legal department (read: secretary) to investigate the viability of the claim.

That this provider turned them off without so much as even following up - I want them exposed. I want to ensure I never do business with them.

It was Dreamhost.

He was lucky, he caught us at the tail end of moving to Webair, we were just tweaking scripts etc before changing the DNS, because we were already thoroughly sick of Dreamhost's incompetence.

But yes, they took down the site immediately when they received his DMCA. I emailed them repeatedly, saying that it was bullshit and that I had proof that we own the copyright to each and every item on the entire domain. The only reply I received was "file a DMCA counter-notification, and if he doesn't take you to court in 14 days we'll put the site online again"

Needless to say we didn't wait around for that shit and just completed the move to Webair. Needless to say as well, he didn't follow up on our counter-notification.

He hasn't stopped. Not long afterwards he got ICANN to shut down our DNS and we were offline again for two days while we got that shit sorted out. He's been sending us threatening emails through our contact form.

DMCA claims are made under penalty of perjury. Deliberately making false DMCA claims - as is obviously the case here - counts as perjury and therefore as a felony, punishable by up to 5 years in prison.

I doubt it would take much to find him if you were in the area. He's one of those people who have made themselves extremely easy to track down around the net, and left alot of personal details floating about that wouldn't make it too hard to find him. It's been a good year and a half since I had to deal with the fat cocksucker, but I would still love to see him mutilated and left for dead in the woods...
