Question for content providers - public content
 
Hey guys, I am trying to understand the world of content and the legalities of it. The question I have is any photos or video that is taken inside of bars, our outside of clubs whether it be at mardi gras, bike weeks etc. What are the binding laws on that? Where its not someone you know, not someone you were there setup to shoot and not something that someone has any expectations of privacy with. Do you need model releases and do you need 2257 information? Now if the content is completely non-nude does that change what you need as well?

I would asume all states in each country are different. Depends where those photos would have been taken. When it comes to 2257, ask a lawyer. :2 cents:

one more try to see if I can catch anyone on now that has any input. Thanks again. Im not looking for 100% yes no or legal advice, im just wondering.

The way I look at it is, if people are in a public place with a bunch of people and they know theres cameras (like mardi gras or bike wee) then they have no reasonable expectation of privacy. but... anyone have experience with this one?

ok input...
inside clubs and events : if you post by door entrance and disclose to visitors that you will be filming then you are good and need no release form..
fully public is mostly 100% considered editorial and news worthy and no release needed.

Model releases & permissions are just formalities. if someone doesnt like you depicting them, you'll get sued. its that simple.

There are a number of good books on the subject - the one on my desk right now is titled "Legal Handbook for Photographers" by Bert P Krages, Esq isbn: 1-58428-059-X

There is a lot of case law on this - meaning a lot of people have sued as stated above - and laws vary considerably from state to state.

Bottom line is always consult an attorney before putting your ass on the line.

Nude or not there must be releases for all actors in the movie, anything exposed. If you blur out peoples faces and they are not interacting your usually ok. If your super paranoid legally, you would need a filming permit to even use outdoor areas.

That's a great book, and he has a free Photographer's Rights .pdf pamphlet that I have printed out and stuffed in my camera bag.
