Google fucked hard. Tubes next?

This is news from Argentina.

Basically it says that a model from Argentina sued Google 2 years ago, Google acted like nothing happened and now they have they assets hold for $AR 746000 (around $250,000) plus an embargo on all trademarks they have in Argentina, including Google.com.ar.

The model asked Google to remove any result that could include her in relation with sex pages (basically she was listed on celeb pages which displayed sex banners, chat, dating and such), they went to courts and Google was ordered to remove all her results and pay $1000 per day until they do that. Google said "fuck off" and now they're under embargo.

To make it worse, this is not the only case they have, but many latin american stars, mostly represented by the same law firm, are suing or already sued Google. The lawyer said they already won between 40 and 50 cases against Google and Yahoo. Last month another model got $86400 from Yahoo for the same reason.

Google representative said "We're not guilty, the company is not responsible for the content, but the site owners".

On a TV show, the lawyer said they were contacted by several law firms around the world to act on their behalf representing many international stars, and that they set a precedent for internet legal responsabilities

btw, this is the model, I found this pic doing a Google search :1orglaugh

Yes, I'm sure Google is just shaking in their boots at the fear of Embargo from Argentina!

Mr.Right - Banned For Life 04-24-2009 12:59 PM

Argentina

:1orglaugh

no much loss

DrChango 04-24-2009 01:00 PM

that makes Google responsible for the whole internet, when you think about it. It sets a dangerous precedence in many ways.

I would have blacklisted her name and anything even remotely associated with it and
then waited for her to beg me to stop.

did you ever heard the words "legal precedent"? that's teh most important thing of teh article, I know 250k isn't much for Google, but with the precedent they can be sued by thousands of celebs with a fair chance that they will win. Geez, it isn't that hard to understand

and it seems US lawyers don't think the same as you, but I'm sure they don't know shit about laws:

Precedent (in this case) means shit unless you live in Argentina.

TheDoc 04-24-2009 01:05 PM

Sounds like Google is.... Shocked...

Other courts have already ruled on this, in favor of Google/Yahoo, courts that have power over them. Maybe that why they continue to ignore them, it's not like a makes a difference.

Agent 488 04-24-2009 01:06 PM

i don't argentina knows how the google works.

munki 04-24-2009 01:08 PM

Even with a precedent supposedly set in Argentina... wtf does that matter to the rest of the world... We all of a sudden respect Argentinian law above local, national and international standards?

bdld 04-24-2009 01:12 PM

i want a ruling in an american court before it piques my interest.

Agent 488 04-24-2009 01:15 PM

always suspected argentina was to be the seat of the new world order.

I don't know, I'm not the one suing Google, I fucking love Google, lol! I do know a little (just a little, not much tbh) about international laws and for what I know precedence is taken in consideration many times, esp when it's related to international firms, that's why Le Havre courts exists

Besides, this relates to the often mentioned need for Internet laws, so my point is let's wait and see. But be careful, what your post is saying is "as long as someone can hide in X country legislation anyone can do anything, whether legal or ilegal".

And I didn't know you owned Google, btw, otherwise why would you have to worry?

Yes, it's legal precedent in Argentina.

Where fuck is Argentina?

_Richard_ 04-24-2009 01:40 PM

I agree. If google complied it would send the wrong message. It's also ridiculous they held google responsible for sites spidered in their search results that they don't own or operate. What are they gonna do next, sue ISPs for allowing access to certain sites? :1orglaugh

Ther isn't any precedent. That's like saying some court in Iran jails a guy for posting pics of naked woman so we should worry about geting shipped to Iran and thrown in jail. Um not likely. This chick won't collect a dime. Google is an AMERICAN company thery can't make google pay that bitch a penny.

Si 04-24-2009 02:40 PM

It's the 24th of April not the first! :1orglaugh

WarChild 04-24-2009 02:40 PM

It'd be funny if Google just banned all of Argentina. No indexed sites, no access from the region to Google or YouTube. There you go Argentina.

EMBARGO ON!
