He extended it so people couldn't sue ISP's/hosts for what users are doing. That would be like making YOU responsible for what your surfers/members are doing with your content - when you have no control over the user.

Can you get a disk burnt off a friend while he is a member of the site or even burn your own disk of the content. If you are a member is the content only able to view from the site or can you rip it for later use..

I dont see anything wrong with this method unless you are trying to make money off the content.

They have to refuse to take down the infringing material for you to sue.

Thing is, the law gives us all the ability for ultimate protection... It's why so many major production companies are starting to produce online, and drm protect it. It's not about the people that 'might' steal it, it's being able to go after people without question, anytime and every place it happens.

This is how they take down the host, or get the domains taken away... You must answer the criminal complaint, or they will own your ass in ways you never thought possible. And this is International, not just America.

Exactly! - That's the point.... Once they did DMCA wouldn't protect them anymore. The person that recorded or cracked the movie, the person that uploaded it, the tube, the hosting company, and even the backbone provider - are no longer protected by the Copyright Act bullshit. It turns Criminal.

1. DMCA is a US law, which means if it is cracked by someone say in canada, your shit out of luck
2. the safe harbor provision would not suddenly disappear if DRM is by passed.
3. the courts have not interpreted that phrasing the way you just did.
