Despite Bush trying, we can still sue drug companies

Bush tried very hard to shield companies that kill Americans from being sued, victory is at last ours.

Quote:

The Supreme Court today upheld the right of patients who are hurt by a prescription or over-the-counter drug to sue the drug maker for damages.

The 6-3 decision rejected a strong move by the Bush administration and the pharmaceutical industry to shield drug makers from lawsuits if their products were approved by the Food and Drug Administration.

Love the Bush reasoning...

Quote:

The outgoing Bush administration told the court last fall that federal approval of a drug "preempts," or bars, juries from deciding whether it is unduly dangerous.
lol

Again, as member of Safe Access Now, we have SUED the FDA over its lies regarding medication lol let alone, just becuse they approve something does not shield company from prosecution.

DrChango 03-04-2009 10:44 AM

I still think it is funny how they bitch and moan about how much it costs them to develop and test new drugs (as justification for their astronomical prices) when the US government hands out billions to them in research grants and the FDA foots the bill for over half the testing process. Fuck those greedy bastards. They need to do a stint on Gang Bang Junkies once a week for a year to get the fucking they deserve!

smutnut 03-04-2009 10:53 AM

I hope they can get that YAZ slut who "plays a doctor on tv" commericals to do a gangbang or two. I wouldn't mind being in on that one!

What many of you don't know about pharmaceuticals is that if they are banned, rejected or recalled in the USA, they almost always get shipped and sold to developing countries like Cambodia or parts of Africa, even if they know the drugs are deadly.

There are few greater evils than the pharmaceutical companies.

The lawsuit in the link is bullshit. The nurse who gave the shot is at fault not Wyeth. The problem is that a lot of people are filing lawsuits for bullshit reasons. You know there are many risks when you take any kind of drug.

Vermont musician whose right arm was amputated after she was injected with an anti-nausea drug made by Wyeth.

The injection struck an artery and caused gangrene, a rare but occasional complication from directly administering Phenergan, the anti-nausea drug.

Diana Levine, the Vermont woman, settled a suit against the clinic that gave her the injection and then sued Wyeth. She contended that the drug maker had not properly warned her and other consumers of the danger.

In its defense, Wyeth said the federally approved warning label told doctors and nurses to use extreme caution when injecting the drug. Levine and her lawyers said that was not sufficient. Who would take an injection to relieve nausea, she asked, if a patient knew she could lose her arm as a result?

The jury agreed with her and awarded her $6.7 million in damages.

In its appeal in Wyeth v. Levine, the drug company argued that since the FDA had approved its warning label as adequate, a jury should not have the power to second-guess this conclusion.

And people complain about increasing health care costs... who do you think ultimately pays for lawsuits, the consumers duh. Letting people sue drug companies is stupid when they have to spend half their time proving to the FDA the drugs are safe to begin with, hell if you are worried about your health you have to take responsibility.

Not to mention they only charge these outrageous prices in the US and in no other country in the world. They really must assume everyone is a fool to believe that little gem about "research costs" BS.

slapass 03-05-2009 05:59 AM

Not to mention we pressure the drug companies and the FDA to get these drugs to us faster. Then we bitch when they are not safe.

So you think in no other countries they can be sued, or have to get their drugs approved? You think it's much easier to get drugs approved in say the UK, France, Germany or Canada? Meanwhile the price for the same drug in those countries is less than one third the price it costs here in the US.

Also did you know insurance companies buy these same drugs much fucking cheaper, likely closer to the prices that the rest of the world pays.. Yet the over the counter buyer in the US gets ass raped and that's ok?

This shit has very little to do with lawsuits that's just Republican BS spin.. It has to do with them having no price regulations and gouging the American public.

I could try to educate you, but then again; it would be like explaining calculus to a chimp.
Pointless :2 cents:

your reply proves you actually have no true debate here and just wanted to get your sig in.

not sure why some of you seem to take offense at my thread, as an American, if someone injected my daughter with someonething and her leg had to be chopped off, or her arm, id want to sue too.

You guys can hate all you want, but this thread is one of my main topics, patient rights. Try to turn it around and hate on me, thats cool, but it has zero to do with the topic and does nothing to encourage discussion about peoples rights as patients, which is what this is about.

The only chimp in here are the ones who have no real point to discuss. lool

Maybe if there weren't so many medical lawsuits, then you could have the Cuban like healthcare you seem to cherish?

Maybe if doctors did not have to have a white female and male nurse so that they don't get sued for racial discrimination, and a gay one too and a lesbian, and now a tranny too so that some fucknut sue them for discrimination, then we would not have to pay $150 for some loser doctor to look at your balls?

People like you are the problem and yet you blame people like me?

Fuck you and your kind :2 cents:

i understand your opinion, however, she won the court case, so its actual "case on the books" stuff now, and patients such as myself, can reference it when going to doctor and choose to not take that medicine.

I am a Migraineur and suffer nausea (extreme) and this is the stuff doctors want to prescribe to people like me. I reject it, i do not want these injections. You do not know what its like being told you must take something when you dont want it. (or do you, i dont claim to know what you know just figure of speech)

Now, once you are administered something, and it starts the process of harming you, there should be SOME protections in place for patients.

As I mention, I a member of http://www.safeaccessnow.org we focus on patient rights and are a collective of patients and doctors, this is one of those topics I follow and just thought others would care to comment.

I think in that case it needs to be qualified people that make that decision.

well the qualified people, The FDA disagree with you as well as Bush and their policy was that lawsuits would/should/does protect consumers.

Quote:

He said the view of the Bush administration "does not merit deference," particularly considering that the FDA prior to the Bush era had favored lawsuits as a means of protecting consumers from dangerous drugs.
second sentence after the one you posted :)
