The borderline stuff doesn't get prosecuted as CP because.. contrary to popular belief.. when the girls in question are post-pubescent, the burden of proof falls into the prosecutors to demonstrate that they are under 18.

Its not my opinion, the DOJ stated it themselves during the flap over CPPA.

I'm not saying its a good idea. They might not be willing to intiate a prosecution themselves over it, but if one of the girls parents ever saw that stuff online and went to a DA, you'd be praying for death before they got through with you.

The odds of that happening might be long, but the stakes are so high it should be prohibitive.

You can tell yourself whatever you want...but if you do not have a model release and proof of age and the girls age is questionable...you are going to be in a world of hurt.

And it is you who has the burden of proof to prove he/she/it is not underage.

In the United States you are presumed innocent until proven guilty in criminal matters. If you'd bother to read the applicable statues yourself, you would find that the only time this isn't true when it comes to KP is if pre-pubescent children are involved. That creates a presumption that the child is under 18.

Maybe you are conflating the civil and criminal issues here. For civil purposes, as I said in my first post, you are correct in that you need to have model releases & proof of age.
