I think we have a congress and the only thing he can actually do is veto a bill that tried to make it legal.

Would he veto a bill in order to stop it from being legal is the only real question.

If Obama wants to go for a second term he can't do things like that, unfortunately.

I never heard of a president that made legislation.
He can ask congress to debate legislation.

I'm pretty sure the president cannot "make" laws. (barring emergency powers)

He can only propose laws and then congress will have to vote to pass them.

I think they have to take it in baby steps and perhaps easing up on enforcement priorities might be a start?
