If your being literal, but are you saying that if he wanted it decriminilized as part of his liberal agenda he would have to wait for congress to bring it up?

I never heard of a president that made legislation.
He can ask congress to debate legislation.

I'm pretty sure the president cannot "make" laws. (barring emergency powers)

He can only propose laws and then congress will have to vote to pass them.
