Can Kazzaa be sued ?
 
If someone finds some exclusive content on the kazzaa network, can they be sued because they are providing a system to make it available (infringing copyright) and they are profiting from the sharing of it (ad impressions).

Opinions please.

I don't think there is a kazzaa network so to speak
every computer acts as a server itself, so the user is responsible for whatever he/she does...

please correct me if I'm wrong...

The users YES,
Last month there was a great raid on Edonkey users in Denmark though, so noones safe... Guess thats the price for "free" software, movies and games

they can't be held responsible for what someone uses their software for.
it would be like suing a gun maker because someone shot your brother.

Last I heard that was very close to becoming law in California. Maybe it is already.. haven't followed that one too closely. Holding gun makers liable for how their products are used is not a new concept.

How do you think they shut Napster down?

Maybe the fact that Kazaa is not a centralized network will protect it... until they get the balls to start going after individual file sharers in the US anyway.. and that is probably not gonna happen any time in the near future.

actually they can. Look at Perfect 10 vs. AdultCheck.

That's like sayin an AVS can't be held responsible for what their webmaster upload. Or a Host can't be held responsible for what their webmaster host.

Let's take CP as an example. First you go to the source of fund to shut the dowm (biller/advertiser) then you hit the host.. if the host doesn't cooperate you go to the uplink provider. Same would work with Kazzaa IMO.

yeah, you can sue the users. i'd like to see more of that happen, but too many publishers are not interested enough, i guess.

RiAA/MPAA are already suing Kazaa it is a jurisdiction problem.
Because of where Kazaa is "located" they are difficult to sue.
However, they are also suing ISPs, who are actually more than happy to comply. That allows the ISPs to kick their higher usage customers.
