Webmasters who shoot their own Content
Quick question, lets say you run a non sex site with solo females posing nude. You took pictures and video of a model a year and six months ago. She calls and now wants the pictures taken down and is willing to pay to get them taken down, you paid her $200.00 per hour when you first took the pictures. How much would you charge her or would you even take them down? She signed a contract and understood what was happening. She is on a solo dvd and in a magazine we have also.
|
Depends on circumstances, but in a word NO. She knew what she was doing, signed a contract, and just like anyone else in the world has to live with the consequences of her actions. :2 cents:

I had a model ask me this same thing and i said a outrageous amount just cause I knew she couldn't come up with it.. I always tell models day one that once the site is live it will stay up till the day the internet dies and have her sign all the contracts.
The site isn't that important and doesn't make that much money but over the last 4 years it has made money week after week and at this point I just don't want to close sites and cut my income coming in cause some girl finds god and wants her tits off the net. Also if you have affiliates pushing the site and you take it down some affiliates might get mad |
There are a few things to think about its not black or white. First how old is she? secondly how conservative is the area you live? Does she know where you live? Also how big is your site and dvds sales and your magazine sales? If you decided to do it, I would say what I paid you and I will take it down.
|
It depends what it's worth to you. She also must understand this is the internet and you can only control your own domains. The video and content will not be erased from the entire internet.

I had this issue twice. In the first case I had the images up for quite a considerable amount of time and they were kind of worn out. The model asked in a very kind way if there would be the possibility to have them removed as she moved on with her life and the images may harm her in the future. In this case I was more than happy to take them down and do her a favour. It was not a big effort as she was just on one site.
In the other case a model's boyfriend demanded to buy the model's images so he could sell them to others and for own use because they both started their own site and she intended to pursue to be an adult actress. I was owning the rights to her very first nudes. I told them I wanted 3 days worth of my work plus all expenses that I had for the shoot, round about 5k US$. They offered twice the modeling fee and threatened to sue me as they thought that was to much. Needless to say I never heard back from them until some time later when I saw her face on an escort site. |

The model in question is one of my top 10 models out of 200 models |
One thing that might work is to put her images only in the member area for awhile until whatever heat the model is feeling cools off. At the least I'd want the money I paid her x2 + my photoshop time + value of the images for additional revenue. But there are always exceptions...
|
Best thing to do is come up with an acceptable number, what you paid her. If she reimburses you what you laid out to do the shoot then take it. I girl sure wont make or break you and it will save lots of possible future headaches, even if legal is on your side. Also did she ask you nicely.
|
If it were me and she is willing to pay back the fee she had been paid I wouldn't have a problem taking the pictures down.
You made money and you will get your investment back. She will be happy and business will go on. |

If she is a cunt, quote a higher price and see what she comes up with. I would say if you spend a day shooting her and another day working on the pics ask her for 2 days of your work plus her modeling fee. That would be a good deal for both. Of course if you shot her 10 times over a couple of months, things would get very nasty and I would think it would get very difficult to pull her content without asking for a pretty big number ... |
We've had it happen a handful of times.
They can 'buy out' if they want. They have to pay for their modeling fees, plus those of every other girls in every scene they have done. So for example, if they did one shoot, and worked with three other girls, she would have to drop in he neighborhood of $500.00. But, if she has been around for a long time. That gets into the 10's of thousands. Needless to say. If they have done one, or many, none have come up with the money. :) |

In over fifteen years of filming I have never had a model request to repurchase their footage. I wouldn't even be able to even if they asked since whatever I film usually goes out in the world to other companies that I have no control over. Even if it was content I owned, how could one put the genie back into the bottle if it was released on DVD, as well as on a site or sites, plus promotional photos, VOD stores, adult databases, affiliates and wherever else the images or videos are?

Think of it as you would any business deal. Dissociate the emotion from the deal and ask yourself, what would you charge anyone, any potential client that is for the exclusive rights to one of your models. Keep in mind what losing that content will cost you, including the cost to replace it.
I don't think it is unreasonable to ask $15,000 to even $25,000 if she's a top model, for exclusive rights and use of the content you own and that is in essence what she is asking. I don't know your business model, so you may even have a higher number in mind. But the point is, look at it from a different angle and you might see it is a deal worth consideration. |

Do what you personally feel is the right thing. You may be ok saying fuck you get lost. Give me 5 grand and I will destroy them. Or even sure I made a lot of money on a small investment.
Really is no right or wrong answer. Just what feels right to you. You have to live with your actions yourself generally. Personally I would just find a fair number to both of us and be done with it. Unless she came at me like a bitch from the start, then I would reply as a dick. |
We tell the girls to pay what the content is worth to us.
|
If she's been nice about it, I'b be reasonable. I've had this sort of question come up just once, and the girl ended up realizing that it would be impossible to really make the content disappear, so she was cool about it.
I'd say charge the replacement value for the content. I.e, shoots with another model that is comparably popular to replace what you are taking down. If you have an amount of content that's large enough to not suffer from the loss of what she had, and the content is older, then consider that as well. In the end, it's always best to deal with people honorably. Don't take advantage just because you can, and try to do the right thing, even if it's not what you want the most. It sounds to me like you have an idea of what to do already, because you've taken the time to post the question and field the responses... |
Shes lucky she didn't choose to do hardcore.:love2suck

most models think 5k pics is 5k reimbursement but the to expect income is important too |
This could happen to anyone shooting content. I think what you need to do is first explain to her that taking the site down or removing her photos from your site will not eliminate the photos from the internet. But if she isn't that popular of a model and doesn't make you a significant amount of money, I believe I would consider complying.
|
Annual income of site x3, plus cost of design ( include your hours as well ) , plus cost of original content.
|
just get her to do things sexually for you + $$ payment, easy enough

That's what attorney's are for... have her buy the content and destroy it. Like someone said a few posts above, put her content in the members area. Also, rule number one... NEVER bring the girls or shoot at your house. THESE GIRLS ARE NOT YOUR FRIENDS :2 cents:

As far as everyone else the talk of charge her 15 grand and so forth. If you dont live in LA shooting adult is a very gray thing at best. One pissed off model could really fuck up your life. Take off your producer hat off, sit and think if I wanted to give someone a mountain of grief in my town what would I do? All the things you think up could happen to you,now if the girl was nice about it and isn't some star. Just a girl you did a scene with or shot a set of. To me having her give back the model fee and go on with your life is the smart thing to do. |

I know your all probably gonna hammer me .. but .. No.. i wouldn't take them down .. just on principle .. I am very clear and to the point when i discuss the reality of the content being on the net forever... I have been offered tons and tons of money over my career to take down content .. if she is in the top 10 of 200 .. not a chance .. 10K will come easily from sales .. and hell who knows .. maybe she is wanting it down because she has something bigger lined up and it could make you meeellions .. ..bring on the hate ..
