i do not see how he will win.

zango is pretty strict about how they distribute product. its not like you can just drop an exe on an infected machine and get paid for it.

all installs have to be done through a portal, where the user agrees to the terms.

in a nutshell zango is going to say that people wanted to see these adverts per their terms, and have done a lot to cover ass to make sure that they can say that.
