The Duck 08-27-2008 10:24 AM

I think it's lame to promote that kind of stuff.

Jman 08-27-2008 10:26 AM

Yikes... that's a hefty fine.

Kudles 08-27-2008 10:29 AM

mynameisjim 08-27-2008 10:32 AM

It wasn't the phony pills that got him, it was the charging of credit cards beyond what customers agreed to and their "auto ship" program. If he just sold the phony pills he would of been alright probably.

But hopefully those ads wont be on TV anymore, I hated that smiling guy.

CIVMatt 08-27-2008 10:39 AM

Yeah I was going to say 25 years at first was a little excessive

sumphatpimp 08-27-2008 10:41 AM

I wonder if he will be selling those pills in prison?
better bring the Anal Ease.

Chris 08-27-2008 10:49 AM

the claims part is nothing to worry about really
as stated in the thread already it was his biz practices that got him and his greed

you could NEVER cancel with them
they would say they would refund and never do it
keep sending after asking them not to

qxm 08-27-2008 10:50 AM

Holly Shit ... Owned! ... now lets here about the annoying Extenze ... with their "Stein Institute" ... lol

Non violent offender. Probably serve time at club fed. Still losing freedom for 25 years isn't easy no matter wher it's served. Being a federal conviction he'll do at least 22 years.

gornyhuy 08-27-2008 11:29 AM

Cah-RUSHED.

gornyhuy 08-27-2008 11:30 AM

I think I would be doing anything in my power to flee the country if I had socked away many millions in swiss accounts and was facing 25 big ones...

I'd disappear into the outback or some pacific island or something.>> Get a little facial surgery and retire into a discrete house in paradise.

I always find it kind of funny how people can get by by doing something a little bit shady... but then they push the envelope just a little bit more and that's what gets them. It seems like every white collar crime ends up like that... they get something going good, and then they just get a little too greedy and push it too far.

Even if he only does 7 of the 25 years paying back that $500mil will likely kill him.

Once the feds pick something up, you're fucked.

95% conviction rate
And you do at least 85%

God Damn, they sure were.
And the whole time I always am thinking I'd hate being any bigger.
I'm no huge horse cock but I would rather be smaller than larger.
If I could be 3" I could get the whole thing into a womans mouth.
Grrr.
I don't like being throated.
Being deep mouthed would just be wonderful.

Jens Van Assterdam 08-27-2008 12:41 PM

Too much attention... thats what killed him.

HomerSimpson 08-27-2008 12:47 PM

Misleading sales are bad thing.
I saw lot of it in adult biz.

In adult it gGoes something like this:
"Join now for free! Just leave us your CC for Age Verification!"

Nothing about charging is mentioned to the customer.
Customer signs up and after 3 days it starts rebilling...

Those doing this should go to jail, since are just robing people and make other from adult biz look wrong in media.

THAT is a misleading statement that you just typed lol There is always the fine print about rebilling after the trial is over AND the customer gets an email with his user/pass & an explanation that he will be rebilled after the trial is over and every 30 days after until he cancels. I'm not even sure why you said something like that when you should know it's not true :pimp

pocketkangaroo 08-27-2008 02:20 PM

While I don't have a problem with the length, it does seem real high. I mean 25 years? Child rapists don't even get that.

And this seems to have less to do about the claims and more to do about credit card fraud. Funny thing is that there are people in adult doing worse. Wonder how long it will take to catch up.

lazycash 08-27-2008 02:55 PM

Interesting comment under that article:

"alright first off lets clear some things up i worked for berkley from 2003 til 2006 every day warshak was there at the office in forest park he was never alone, he was always with 10 to 15 lawyers, he had to forfit 20 mil. he hid some in cali were he lives, his wife is a high risk pregnancy MD and has an A list of cliants, warshak also owns fathead which he used to launder money that was suppose to be forfited, with that out of the way lets get into what he did,
twice while i worked there the fbi showed up they made us leave all work all paper and even our cellphones there .my team lead steve pugh (steve was a hunchback, had some type of scoliosis) went to the warehouse and hid mass amounts of enzyte and avlamil the reason is the pills did not weigh what they were suppose to hence what was in the pills was not what was labeled. credit cards were charged without concent and ppl were put on auto ship when they had just asked for the trial pack"

robfantasy 08-27-2008 03:12 PM

ever tried to get a refund for cell phone bill charges?

cell phone companies are the biggest crooks.

-shitty service
-hidden charges
-stonewall refund policies
-terms buried in pages of legal speak you need a lawyer to decode for you.
-locked into contracts you cannot get out of

the world is really fucked up

dynastoned 08-27-2008 03:28 PM

thats what happens when you try to hide money from the feds. :2 cents:

The Only Time Whales Get Harpooned....

Is when they COME UP TO SPOUT.

Think about it.

PS Joe Francis played with the same game of auto shipping and got nailed too.
He paid a hefty fine-

But then again- he is still going through some Federal Tax shit and he can end up losing everything as well.

"The key to the scheme was Berkeley’s “continuity program,” which automatically charged additional orders of Enzyte to credit cards each month. The program was not fully disclosed in ads, and customers who complained were given the run-around or referred to a “quality control” officer who did not exist."

I wonder if some of these cross sales that are going on in this industry could be targeted in the same way.

No they are apples and oranges. A member gets emails with cancel links as soon as they buy a membership that has a pre-check. They get an email from the "host" paysite. AND a separate email from the x-sell site. User/Pass and full instructions and links to cancel are included along with support phone and email. So "no" All this x-sell drama is just that: drama Been going on for years, and adult didn't invent pre-checked x-sells. They've been in "mainstream" even longer. Not to mention the "Free" software that people download to this very day that installs shit like zango and other programs on your computer without your knowledge.
