Jim Brown Sues Sony And EA!
 
After years of barging over husky defenders on the gridiron, ex-Cleveland Browns running back Jim Brown is attempting to tackle two serious video game heavyweights in court.

According to Bloomberg, Brown has filed suit against Sony Computer Entertainment America and Electronic Arts over using his likeness in the popular Madden football series. He seeks a court order preventing either company from continuing to use his likeness in the franchise as well as damages stemming from trademark violation.

I thought the likeness and use of the players names and so forth were licensed through the NFL players club/union, not the individual people.

If I remember correctly, it's licensed thru the NFL with "approval" from the players union.. However, there are occasionally exceptions that can't be used... For example, I think in the case of the NBA there were a couple players (Michael Jordan for example) that were excluded and you had to get seperate deals for them.

Ever wonder why there's never been a Tennis video game that included all the top players?? They don't have a union and you have to try and license each player individually which simply isn't financially feasable.

He will lose. If he wanted the Browns ot take down pictures of him in a Browns uniform while he was employed withthe Browns, from their headquarter could he legally make them do that? Nope. So if the Browns say it's ok to have Jim Brown in Browns uniform he has no say so. In fact if he wanted to sell autographed pictures of himself that showed him in action in a NFL game he would need permission from the Browns and the NFL.

The problem he states, as he sees it, is that he played before there was a union and before there was video games. He may receive no money for this and that is what he is seeking.
