legal: does dmca protect these guys at all?
just curious, see mainstream blogs and picture sites etc all the time where the webmaster is using photos from all over the place, it would seem to me that dmca loopholes shouldn't protect them at all as they are the ones posting the pictures for which they didn't obtain rights... wouldn't it be a slam-dunk legal case if they get noticed?
seems kind of pointless to build a site that will eventually get serps and get noticed if you are going to get fucked if it gets popular enough to attract attention :2 cents: am I right in the thought that a cease and desist doesn't even have to come first, and a liability lawsuit or a demand for $$$$ can be the first notice that an offending webmaster might receive? |
yes

If you are thinking of getting into this niche, and are that worried, and do not know about LLC's and how to protect yourself (i.e. basic business practices), then go find another niche toots. :2 cents: |
Say you want to show a picture of a Sony LCD TV... You had better get it from Sony because someone else is going to get pissed like Circuit City when they see you ripped their picture.

I don't even see a DMCA link and I don't see most give credit for who took the picture.
