Whats all this about legal and illegal tube sites?

Can you even have a legal tube site?

I mean it is the users who upload so and unless you are prepared to screen every single upload and then check if it is breaking any laws are there really any legal porn sites?

You opinions....

The term "tubesite" has been stretched as far and wide as the term Web 2.0 ....

Just cause its tube doesn't mean its illegal.

Stolen, copyrighted material used without permission = illegal...

Licensed, used with permission = legal

How will you ensure that your users upload legal material?

You screen it before it posts.

Most scripts, that I have seen, provide this option.

As for the OP question. Legal tube site is like myself, or a sponsor, filling the site up with our own content. So it's on there, and being used with our permission for the sole purpose of marketing our products.

I think thats a great question. Being the first Tube affiliate program, we had to really sit down and iron out what we can and cant offer in our tube site, Gutter.com. So, heres what we came up with...

Uploads - All content we have uploaded has been from 19 of our 3rd party sponsors.

User uploads - We do our best to portray Gutter as a user uploaded site but fact is, its not. Users have a panel where they can upload videos and when they try, they are prompted to contact administration with all the legal info and paperwork for the video. Once a user has provided ALL legal information like IDs, model releases, proof of production date etc... then we will allow the upload. Once the video is uploaded, its queued up for review by an admin. If all looks well, only then will we go live with the video.

This process ensures that Gutter.com is and will remain a 100% legal and 2257 compliant tube site our affiliates can promote :thumbsup

Anything a user uploads "could" be bad. They don't have the rights to upload it unless they produced it and in that case you need 2257 docs (release forms + ID's) from them to use it so your protected.

Uploading videos yourself is the safest way and the way 99% of my clients prefer.

Any site that has user uploaded content is very dangerous since you don't know what user is going to upload something illegal or not, or does he owns the license for it or not. So those kinds of sites are very risky to run (this includes blog hosting services, image hosting services, video hosting services - tube sites...)
