I own GoldenPalace.us but I have big problem now.
 
Hi guys!

I need your help. I own GoldenPalace.us but I don't stop to receive email from lawyer asking to stop using this domain and give the domain name to Godaddy GoldenPalace company account. What you think I need to do about this? Give to domain and that's it?

They can ask anything they want... however, since almost every name for a domain is in use, there is going to be overlaps in usage. They don't have the right to it from what I understand... thats why you can get dot comes dot ca s dot tv etc...

You could give it to them or you can hang onto it... Everyone in their dog is going to say their domain is trade marked...

It also depends on your state laws... if you are in a different state and its bi laws on business name usage allows for it I would speak to their offices first and see if they will back you... ( its their job. )

or

Sell it to them for $10,000 and tell them if they did not like it then to go fuck themselves...

they dont have to buy a trademarked name domain from you. you're squatting. eventually you'll end up giving it to them or the registrar will take it back under court order. just give it up and save yourself the headache.

the name is trademarked. he has no right to it unless he purchased it prior to the trademark and prior art proofed. he didn't register it cuz it was a cool name. he has no right to the trademarked usage of their brand. sadly this is a no win, no negotiation situation he's in.

It is a registered trademark in the US.
You pretty much have no chance, and you are guaranteed to go for a long legal battle if you wanted to fight it.
Give it to them and hope they don't ask for damages is what I would do.

That is correct. I just had a friend who went through this. He was lucky to not get sued in the process. I believe it was ICANN that stepped in and took the domain from him and then he had to appear in court for damages, but it was dropped.

I understand your point, however, there is a difference between state and federal laws... you could go into one state and find a shop called abcdefg then go in to another state and see the same name at a different business... technically almost everything is trade marked with a few exceptions... all I'm saying is that bigmath should get in contact with his state ran service that deals with business name registration and name usage...

GoldenPalace while a trademark for GAMBLING does not entitle them to the domain GoldenPalace.us UNLESS such domain is gambling related as it is diluting their mark and in direct competition in the same area of commerce.

Now, if GoldenPalace.us was the website of say, a chinese restaurant named Golden Palace then goldenpalace.com has no legal ground nor a leg to stand on and has a losing case.

What if GoldenPalace.us was a website about the TV show?
