CNN - 70 arrested in Australia in pornography sting!!
 
CNN - SYDNEY, Australia (AP) -- Australian police have arrested 70 people and removed four child victims from homes in a six-month nationwide investigation of a global child pornography network.

Police said 20 other people have been summoned to appear in court. The 90 face charges of accessing child abuse images on the Internet.

Australian Federal Police Commissioner Mick Keelty said Thursday the investigation was conducted simultaneously by law enforcement authorities in 170 countries. Further arrests are expected.

The maximum penalty for possessing child pornography is 10 years imprisonment.

Keep in mind that "child pornography" also covers the nude self-pictures that quite a few teen girls take. You know, the ones that often get posted on message boards. The ones that you may have seen, and which have thus been cached on your computer, without you ever realizing that the girls were in fact under 18.

First off, do you realize that for the police and media, anyone will be referred to as a kid up to the second before they turn 18? "Sex acts with kids" can refer to a 50 year old raping his 2 year old stepdaughter, or a 19 year old having sex with his 17 year old girlfriend.

Obviously, the two are rather different. In the press release, though, they will both be referred to as "sex acts with children".

That's why it's so fucking stupid to demand high minimum sentences without knowing the details. With a 10 year minimum sentence, the people who download a homemade video of a 17 year old girl giving head to her 18 year old boyfriend without even knowing the girl is 3 months younger than the law allows will also get that minimum sentence.

First of all I started this thread because of the Australian CP arrests for some reason it has be turned around to be "Child abuse" and a case that was held in Georgia USA, there is no comparison...

You fail to see the link between someone getting a ridiculous 10 year sentence because that's the mandatory minimum, a minimum which was most likely inspired by the general outrage that the very words "sex" and "children" cause when put together, and someone crying out for a mandatory minimum of 10 years regarding a crime, outraged by the fact that there are both children and sex involved?

Child abusers, child rapists, cp producers, cp traders, etc. should all be thrown in prison for the rest of their lives. I think we can all agree on that.

The 18 year old guy who downloads a self-shot picture of a naked 17 year old girl while believing the girl is over 18 should probably not be sent to prison at all. I think most of us will agree on that, too.

In between those two extremes, there are many different cases. The cases which might technically be said to involve "child pornography" but which in reality lay closer to the second example than to the first are a very good reason why minimum sentences are a bad idea, and why being outraged without knowing the actual details is less than productive.

Just recently, I read about a girl who got charged with production of child pornography. She had taken pictures of herself, and had posted those online - while being under 18. That example alone should make it rather clear why it's pretty much a smart idea to get to know the details of a case before even thinking about appropriate sentencing.

I live in Australia, and the news stories here outside of that one article have been rather specific as to what these scum were doing.

People also do not top themselves either of they have not been doing anything wrong.

I will not apologize ever for being forthright on these issues.

And just as a standard you can be absolutely fucking certain that I would not give a flying fuck if you were fiddling them or if you just had "artistic" pictures of them, you would be a fucking dead man and I would happily do the time.

Your idea to institute mandatory minimum sentences is a bad idea not because those who rape children on a daily basis should not be locked up in a doorless cell, but because mandatory minimum sentences would also hit the ones who, for example, come across a naked 17 year old on a message board.

Judges and juries recognize the difference between a 50 year old raping a 6 year old and an 18 year old dating a 16 year old. Likewise, they recognize the difference between someone who has thousands of hardcore child pornography pictures on his hard drive, and someone who has thousands of amateur nudes on his hard drive, one of which happens to be of a 17 year old, while the rest all feature adults.

Mandatory minimum sentences make it impossible for sentencing to reflect these obvious differences.

No, they are specific as to what *some* of them have *allegedly* been doing. False arrests can and do happen, and while some of the people arrested undoubtedly are scum of the worst sort, it is quite possible that others will turn out not to be pedophiles at all.
