Public Photos and Movies... Do you need 2257?
 

Hi,

I have alot of photos from frat parties, night club, and street parties picture and movie clips. Do I need a 2257 on this? I was told when its in public, the content gave their rights away. I can use everything.. TRue or False?

LOL. Sorry for laughing but do you even know what 2257 is? It's a records keeping law that says you need to be able to provide proof that anyone that appears in any content on your website and is naked is of legal age. Good luck telling a judge that it's okay to have a 17 year old in a photo or video on your website because it was shot in a public place.

What if you in a night club?
 

What id your in a night club that you have to be 21 or even a street party you have to be 18 or older?

I have all these pictures on my site that has girls in a bar flashing, I really need a 2257 for this?

You need to have 2257, which is a picture ID of any models haveing sex.

If all the model is doing, is showing her Breast, then you are OK. But if you don't have a model release, the model could go after you, as you are profitting from her image.

You are aware that teenagers often use fake IDs to get into clubs, right? It's not up to the bar owner to prove that the girl in your content is of legal age, it's up to you.

Why don't you do a little research on another guy that makes money from girls flashing their tits in public places. His name is Joe Francis and he owns Girls Gone Wild. Maybe you've heard of him? Did you also hear that he was recently arrested because of two 17 year old models?

Sure, he got off on the charge but he had to pay millions to the girl's families and his attorneys. Do you have millions to defend yourself in court? Even if you have a winnable case, if you can't afford to properly defend yourself you can still be convicted.

Even if everyone is 18,21 or 67 & they are not "performing", you still technically need a release in order to publish/broadcast their image. I think... but maybe Im high on crack...
