my site stolen?

ok this is pretty fucked up.

www.hqerosescorts.com is my domain, when it loads it goes to some other site.... my name servers are still the same, all files on the server are the same, yet somehow it redirects to another site....

any ideas?

Sorry mate, I thought I found your problem but when I rechecked I was wrong and edited my post

Sebastian Sands 05-14-2008 04:46 PM

you have their trademark in your name and you are targetting the same traffic they do. I think they took it. At least it looks that way.

lazycash 05-14-2008 05:00 PM

Is this you in the whois, if not then it does appear you do not own the domain any longer. http://whois.domaintools.com/hqerosescorts.com

MattO 05-14-2008 05:01 PM

Looks like Group Kaitu, LLC owns it now.

Yep, which is the Company that owns eros.com It appears they did indeed take it from you probably because you infringed on their name. About ten years ago when I was a noob I registered some domain with Yahoo in it and after a few months it suddenly became property of Yahoo.

OzMan84 05-14-2008 06:40 PM

Eros is just a word....so its not my fault they registered a one word domain back in the day.

Well you could certainly fight it, but I doubt its worth it unless your site was bringing in substantial revenue. At least contact your domain registrar and find out what they got served.

bdld 05-14-2008 08:30 PM

you shouldve gotten some sort of notification from your registrar

Sosa 05-14-2008 09:00 PM

oh wow, that is fucked up man. I know you put quite a bit of work into that site too.

Azoy? 05-14-2008 09:02 PM

weird how they just took over like that

skillfull 05-14-2008 09:02 PM

that's really fucked up

MediaGuy 05-14-2008 09:06 PM

Was it simply that you had the word "eros" in your domain? It appears by your domain you were also promoting escorts, were they the same escorts from eros.com?

fogfever 05-14-2008 10:19 PM

Looks like it was taken away by URDP.
I can't post the link, but do a google search for your domain - hqerosescorts.com and the second result is you losing UDRP case.

The whois was private, so you probably never got the notice.

B. Respondent

The Respondent did not reply to the Complainant?s contentions.

kaori 05-14-2008 10:49 PM

That's kind of lame!! I would have thought you had a pretty good case - if you had responded :)

Eros was the primordial god of lust, love, and intercourse - seems like it would be hard for a company to claim rights to that....

sicone 05-14-2008 10:54 PM

Ouch... sucks ass.

Why didnt you respond to the complaint?

I think due to privacy protection on the who is.

Really makes one think if this really could be abused to hell and high water against people hidding who owns a domain.

OzMan84 05-14-2008 10:57 PM

is there a way i can respond to it now?

the email is still valid in the whois with WhoisGuard, since it forwards to the domain owners address....so emails should have been received ?...

OzMan84 05-15-2008 12:55 AM

Well in the complaint it said they owned 90+ domains with "eros" in it, so maybe they are vigorously pursuing domains with that word in them.

Hate to say this but actually they can.
They appear to have a trademark on the word Eros and they are in the escort business. Your domain was just HQerosescorts which just comes off as HQ Eros Escorts. Then you also were in the same line of business which would of been the only possible escape clause.

Think of it this way, it is like making a site that is called:
HQcokesoda -promoting soda.
HQstarbuckscoffee -promoting coffee.

Then they are technically required to protect their trademark or potentially face loosing it if they do not enforce it.

OzMan84 05-15-2008 01:44 AM

how can some promoting escorts make Eros a trademark? when eros is a greek god?

i can agree with your example hqstarbuckscoffee tho.

They file for a trademark, go through the waiting process and then are granted one.
Eros is not the first nor last normal word or phrase used.

Now they can not prohibit someone from using the word Eros when it does not infringe on their business. There is a EROS data center used by the US government that would not infringe on their trademark. There was also a movie by the same name that had some erotica (close but did not infringe).

If someone wanted to get a domain like for example sinsoferos and dedicated it to the Greek god or even a beverage that boosts your sexual abilities would not be infringing on the named trademark.

Hell ask a trademark lawyer they will explain it to your and your frustration.

No, not necessarily since the email forwarding on those WhoisGuard addresses only works 10% of the time.
