so my friend just told me about a fucked up situation she's in. she's been working for the city gov't in FL for over 4 years now, a new mayor has come in and is busting things up... basically, if she gets 'fired' she can collect unemployment.. if she quits she cannot (from what i understand)... she has dirt on the mayor so they are not firing her, they're just slowly torturing her (to the point she calls in sick, stays home vomiting over it)...

my question to you keyboard lawyers is, is she acts up (hey mayor, fuck off!! or yeah mayor, maybe i'll get to it today, maybe not... answers phone 'putz's office, can i help you?') does that go over the line and when she gets fired over it she'd then forfeit her ability to collect unemployment?

what does she do? how can she get fired?

this mayor has fired a whole slew of ppl who worked for the old administration and he's torturing the ones still working there...

If she quits for a good reason (harrassment etc.) she can collect her unemployment. If they fire her for a good reason (missing work etc.) she cannot collect her unemployment. A double edged sword.

Was a manager in Florida for years. When I fired someone and they tried to get it they would have a meeting over the phone with the guy that got axed, me and the unemployment office. He would pled and I would say why he was such a fuck up and they made the call. If she gets fired for doing shit like that and the mayor can prove she would probably not win at all. Have her make mistakes that can be just that "mistakes"

FWIW.. You can get UE if they fire you due to downsizing / lack of work.

nah, trust me they can FIRE you due to downsizing or lack of work.. not just lay you off.

I seen it happen recently to salary people.. hourly got laid off salary got fired.

Realistically the best advice you can give her (if she isn't already) is to start looking for a new job. If they don't like her and they know she is looking to leave they may give her a glowing recommendation just to get rid of her.

It sounds like she no longer likes the job and the mayor isn't going anywhere so she might just be best off leaving.

Unless what she has on the mayor really is good, then she could always just "leak" it to the press. If it is good enough the mayor may end up going before her.

Sounds like she is unhappy. Why not looking for another job, keep the current job, and when you have something new, quit...

She is relatively fortunate she 'only' has four years in - it's the people within a couple years of retirement that really get screwed in these situations...

What I am curious about is what exactly is the dirt she has on the new mayor.... if it falls under a whistle blower statute then she should probably seek out the advice of an employment lawyer in Florida. She might already be well protected.

Threaten to leak the dirt to the press unless she gets paid one years salary with benefits as a severance package, and out the door she goes with a check in hand. Just make sure she speaks to the Mayor in private and she is not being recorded!

It's fairly common for a new mayor to come in and bring his own people. Many city positions "serve at the pleasure of the mayor". I know someone who is a prosecutor and after 24 years, the city got a new mayor for the first time this past year. Luckily, he didn't make any changes, other than secretarial.

But if she really has dirt on him, then drawing her unemployment should be no problem. Her employer is the one who gives the yea or nay on that. Tell her to tell him that she'll leave and when the city is contacted about allowing her to draw, they should ok it. If he says no, then she obviously doesn't have much on him and she's lying about the not firing her part.

Correct. You can collect unemployment if you are fired because you can't do the job, meet the requirements (like commission). Also in layoffs, downsizing, etc..

However, you do not get to collect it if it's because of other things that are considered voluntary such as missing work, no call- no show, attendance issues, insubordination, code of conduct violations, etc.

Of course, it's not always a black and white issue and you can, in some circumstances get it if you resign, like in the case of harassment, or FMLA turned down, and such. But you typically have to file appeals, and wait it out in those cases.

I've been through it myself, and was also a union steward where I dealt with these exact issues. But that's not to say laws can't vary state by state.

because she's on the verge of retirement anyhow, and the mayor and his staff is torturing her... not only is she looking to get employment out of these idiots, she's gonna get him impeached afterwards (not sure if thats the term for busting a mayor out of office)

You just said the same thing i did. and said i am wrong. not sure if you notice that. these other situations you talk of, racism, sexism so on so forth are few and far between, and i would call a lawyer before i would call an unemployment office that is for sure

As someone else suggested, she should go to the Mayor, explain what info she has and ask to be fired with no contesting in order to collect UI. The employer pays into UI, it's not a government handout (though it gets tricky if her employer is the government but that's a different thread).

Either the scoop she has is enough to get the UI or it isn't and she needs to tough it out for a full paycheck if she's that close to retirement.
