Some interesting opinions from the Attorneys.

Gives non-US webmasters some extra stuff to think about while they are applying for a US presence.. :eek2

what we have here is that, Website by Website, they're going to know what's going on. Now, you have to understand that knowing what's going on Website by Website should be immaterial, because if you were going to take a look at the recurring billing situation of, say, a gym, would VISA and MasterCard care how many chargebacks come from the Westlake Village branch of 24 Hour Fitness versus the Van Nuys branch? No, they don't care. They just say it's one corporation and want to know what the chargebacks are for the corporation. So why would they be interested in chargebacks Website by Website? Well, because for criminal prosecutions based on content, it's Website by Website.

In such a scenario, where an unsupervised para-governmental entity can potentially stage-manage the exile of an entire industry, one has to wonder why any company would allow itself to be manipulated toward its own banishment, not to mention to turn over on members of its own community. "Because the affiliate program Webmasters [sponsors] have made so much money they'll do anything to stay in business," explained Piccionelli, "just like these aggregators will also do anything to stay in business.

anyone that still thinks all of this is a good thing for the industry, needs to stop kidding themselves.

Now I hear that VISA has clarified its 'presence' requirement. They will require all companies to have actual staff people in the U.S. This raises interesting implications, including a requirement that the companies now pay U.S. federal income tax on their earnings

Damn.

I think that this is totally untrue. If Visa wanted to do this they would have already terminated the IPSP's for factoring. In a way their resolution is extremely liberal.

I bet that the IPSP's are in fact thrilled by what has happened. It completely legitimizes their businesses and gives them a status where they had none before. It will be far easier for them to seek capital, and the $250 cut of the registration fee is a windfall of millions for the larger IPSP's.

And as far as a USA presence requiring ownership percentages goes, I feel this is unverifiable. Do you think Visa is capable of going through everyone's corporate records and sorting this out?
corporate registry statements are notoriously inaccurate.

If you set up a Nevada corp properly it is totally impossible to find out. So they would have to believe whatever you tell them.

So Says Ron C of CCBill:

"I can assure you after speaking with Visa they do have a very different view than some of our competitors regarding these new rules. As Visa kindly pointed out to me these rules were created by the International side of Visa, and the US was the last to adopt them. "

So Says Visa:

"Janet Yang, the Visa USA rep, responded, "When Casey referred to this as a USA matter, she meant that this new policy was initiated by the US region. How this plays globally ... I'm not sure..."

Even the attorneys in the article thought it was safer outside the US.

Hmmm, lying to save some bizness? :warning
