Domain Gurus...Please help me, I need your help
 

Hey All,

I recently purchased a domain name. It turns out that the domain i purchased is also the name of a lawyer that announced she was running for US Congress the day before i bought the domain name. She lives in a different state from me, nowhere near me. The domain name is a very common russian girls name, which is why i purchased it. She has had her law firm contact me and are threatening to sue me if i do not give them the domain name. She is claiming that she announced her bid for US Congress the day before i purchased the domain name and therefor has legal right to own it and can take it from me.

I spoke to them on the phone since they have been faxing me papers telling me to hand over the domain name and i told them no. I currently have it redirected it to a porn site while i am designing the site. she is claiming that I can not do this and is now giving me till March 13 to hand over the domain name or else she will sue me for the domain.

What i want to know is, what are my rights. Do i have to give up the domain name or can i tell her to buy it or tell her no thanks i am making a porn site on the domain....

Good for you...dont give that name up at all.
You should go public to the media in her area and explain how she is the DOMAIN bitch. And show them how she is strong arming you for the name.

Domain name would be useful. Ask a lawyer, but if it is a common name and the domain isnt something like (her name)4congress I do not see how they could do a fucking thing but waste money in a lawsuit.

its a very common russian girls name, first name and last name. one of the most popular combos... i just dont want to list it in case they do a search and come across this board. its her firstlast.com i told them over to phone to just register .gov or .org .net....

i just want to make sure legally i am fine and will not get sued and lose money as well since they mention they will sue me for $$$ as well.

Turn it over ASAP. If you get sued, it will cost you a fortune.

I think that since her name is not trademarked, and it is a common name, and she does not live in the same state as you so you had no idea she was running for congress that she legally has no claim to this domain name. I think that you can fight her on this and legally have every right to it as she does. I would contact a lawyer just to be safe but there are plenty of guys on GFY that have the knowledge to help you.

I would ask Daddyhalbucks to explain why he says to get rid of the domain so you know his view....

What I would probably do with it is put it on sedo for now. Don't redirect to a porn site 'for now'. Then I'd see a lawyer.

Bad move, let them make an offer, if you ask for money it could serve as an evidence for cybersquatting.

It's a dangerous move to redirect it to porn, since this puts pressure on her. She can either pay for it quick or she has to move forward agressively with her lawyers, maybe even hit the media and present you as a bad porn guy trying to ruin her reputation.

I'd redirect it to something less offensive, get a lawyer and go for a gamble, but I wouldn't provoke her...if you force someone to act, you kill your chance for working out a deal both sides are happy with.
