Would you bring somebody to court because of SPAM?
Hi,
My question is, lets say you own a message board & you get spam from an individual repeatedly & warned whoever is hosting is site with, the owner of the freehost warns the spammer & the spammer stops without deleting is account. Would you still take the spammer or the freehost to court because the freehost did not delete the spammers account? What would the plaintiff sue for? Personally I think the plaintiff is wasting time & money, what do you guys think? Pornjudge |

I reccomend you go read the ftc guidelines, state/local laws, and dont forget to take your prozac freak. I hope you choke on your tounge tonight while you sleep lol |
How were you damaged?
Can you prove money damages? Didn't the host comply with your request? Did the spammer keep spamming after your notification of the host? There are some state statutes banning spam. You can sue under those statutes and try to recover attorneys fees. This should be a good deterrent since attorneys fees are NOT cheap. The damage to be proven is different under these statutes.... they basically work to enable private parties such as yourself to use the courts to enforce public policy against spamming. Your reward is the attorneys fees. Quote:

The delete key is the easiest method to rid yourself of spam. I have become an expert in the use of the delete key.
