This VISA shit would not last

I'm sure, why?, because of the American law system, IMHO, as soon as the next week, someone, maybe the ACLU will be filing a plaintiff or lawsuit and getting an stop order from the court until the whole matter clears up or get to a trial

What are the chances of this to happen?

I'm not American, maybe i'm just guessing, but i think is possible.

Brown Bear 10-04-2002 10:59 PM

You're assuming that America's judicial system is fair and functional. Unfortunately it is not.

Remember this guy?

I think some lawsuits will be filed, how successful they will be who knows.

Antitrust, price fixing, NAFTA violations, possible constitutional violations.

El Demonio 10-04-2002 11:03 PM

I'm counting on it to be precise.

But is not realistic to think that every webmaster in the industry is going to sit and watch, and bow their asses to VISA. Someone will do something.

El Demonio 10-04-2002 11:05 PM

I think is not even needed to be successful, just to get the court stop them for a while, a BIG while.

In that time someone will pull out some great solution and we all kick VISA's ass

SpeakEasy 10-04-2002 11:11 PM

You are just dreaming, becauser as a foreign webmaster you are going to basically be out of buisness in a few weeks. Unless you become a US based company. This Visa thing is a very harsh reality for everyone, and for some it's worse then others. But as far as it being stalled in court, well that is Not going to happen.

El Demonio 10-04-2002 11:16 PM

And i think you work for VISA.....

TheFLY 10-04-2002 11:20 PM

Who is going to care enough to sue? If you can afford a lawyer to sue VISA -- surely you can pay the $750, etc. The big sites are happy about this...

El Demonio 10-04-2002 11:23 PM

Happy?, why?

VISA can terminate them at its sole discretion.

ColKurtz 10-04-2002 11:33 PM

"The big sites are happy about this..."

I think for the most part they are but they are talking out of both sides of thier mouth.

On one hand its a "barrier to entry" to keep the little guy down. Why is there any reason to fear some little guy?

Then on the other hand they admit that the reason for these regulations is unscrupulous big guys that use fradulent smoke and mirriors billing tactics.

Why not just punish those abusers. This is the thing that pisses me off. These 3rd party guys know who the abusers are but continued to take their business.

Now its a shit sandwhich and we all got to eat it.

Im all for barrier to entry, but not in this way.

How fast an injunction can be ruled in court?

andi_germany 10-05-2002 02:50 AM

I see 2 possible lawsuits here. 1 against VISA and 1 against the billers that did price fixing over the last month when they kept this quiet.

The foreign webmasters actually have the most valid claim. It is Discrimination. There effectively is no good billing company outside the US which means they are pretty much locked out of a multi billion dollar business. I am sure you will find a lawyer to work such a case for a percentage of the amount you might get. Its the way big cases work for decades.

Yes one could claim that its their ball, bat and playing field but that stadium is on someone elses playing field, the government does not tolerate bullies for long. Adult might not be the most desired topic but freedom starts with every person or business and the supreme court has proven that it values freedom and we are talking freedom of trade here. I am very sure that the US has several trade treaties with many of the countries shut out now.

I can tell ya one thing as soon as my rebills stop you will see just how much I care!

Killerelf 10-05-2002 03:36 AM

I am surprised that there has been nothing of this on the tv. At least that I have seen. And why is the government not involved yet? What VISA is doing has the potential to hurt the worlds economy. Not like things are not fucked up enough already

Gizzy 10-05-2002 04:46 AM

you people act like this is something new (the visa thing)
its not!
those with merchant accounts have been paying this fee to visa for awhile now, last july we was hit up by master card. Watching this panic is funny as hell, wait till mastercard hits you up with the 1000$ registration fee and then the annual fees.

damn stop stressing, if you cant pay the tiny little 750$ then you wasnt making enough to be in this business to begin with.

I give master card 2 months before they announce their registration fees to the third party processors.

jimmyf 10-05-2002 05:45 AM

This will not be happening "JUST" to the porn business. It will be ALL High Risk business's. And porn is not the only high risk business...

2dXtreme 10-05-2002 07:50 AM

OK, call me paranoid BUT

From what I read on all boards:

The only information stream we had on this topic is from the 3th party billing companies. On Visa's site there is nothing about this whole matter and I spent a few hours searching!

Can somebody with his own merchant account confirm that Visa is imposing this on adult companies? Or perhaps is Visa imposing this on 3th party billing companies only.

That would also explain how Globill gets around these rules. Perhaps they are one of the few billing companies that run a tight ship regarding chargebacks?

Maybe I'm crazy, but it sure smells fishy to me that with an event like this there is almost NO information out there to find except on the sites from CCBill and the others that are struck by it.

Just my :2 cents:

vegasdude 10-05-2002 07:55 AM

its not about the fucking pennies Gizzy...

its the fucking US presence thats the worst if you ask me...

nobody and I mean nobody is gunna tell me where im gunna locate my business - end of story! and its actually against several european laws!

Vegas

Adultbouncer Rob 10-05-2002 08:05 AM

woo!

there will be 100,000 lawsuits.. poor visa :)

cyberpunk 10-05-2002 08:22 AM

I'm pretty sure this is in violatoin of NAFTA, but am I gonna sit around and wait to see if somethign changes, and risk not getting having everything done an dloosing rebill which would mean loss of my income and imcome from affilates?

NOPE for me the 750 will be like insurance in this case, if it turns out I didn't need to pay it but did my affilates still get paid andI"m happy.

If it turns out I did need to pay my affilates are happy.

Happy paid affilates are a good thing! :)

DarkDollars home of freeky chicks and happy affilates ! :)
