Legal views on the VISA regulations
 
I am wondering if the VISA regulations are legal?

Following thoughts:

VISA hasn't published anything yet and I wonder if it is legal to change regulations so drastically without prior advanced notice. This leads me to believe that the billers knew it for a long time and now they just do it on short notice so they don't loose much business. This might be grounds for a suit against the billers if that would turn out true.

If an industry leader imposes extortion methods like: pay or die (they don't say it like this but basically it is like it) would it really be no problem? Microsoft did it and got sued.


So can we really do something about it? I think we can all hit VISA where it hurts. Money

Simple step. Pay the fee and then we all increase the VISA payment option. $20 for MC and other cards and $25-30 for VISA explaining to the customer why this step is necessary. I see 2 advantages. First of all it will keep MC for doing the same shit because they can see a lot of money coming to them and VISA will loose a lot of money and they might consider this new regulation.

The problem we have is that most people in this industry just want to duck out of the heat and just pay the fee. I have a foreign corporation but luckily I got a US social security number and bank account and therefore will just set up a remailing address and use that to keep my rebills but most other foreign companies aren't that lucky.
I will for sure make VISA option more expensive and I will let the surfer know why. Lets all do it and I think we might even get to change something

I have a carribean based company but I lived in the US for 4 years in the past and therefore still have a personal US bankaccount and a social security number. Not sure yet if that will work but I just emailed my lawyer to get advice on this.

You can open a US bank account, US corp, US address, etc...

But... YES, you will pay US taxes.

But... you will also gain valuable credit history and income history, that will allow you many advantages on things such as:

buying property in the US!

You can also get auto-loans, home-loans, credit cards, etc.

1 and 2 are if you purchased the home outright.

tax breaks. If you are going to pay $1000 dollars a month in income tax, might as well pay for a home on a beach front, then pay the IRS, right?

The rent would pay for the bank payment if you purchased on credit.

I am sure there are MANY other advantages, but I am no expert.

Your credit history in the US is like GOLD. You can do so many things with it. Simply put...

You have a decent vacation spot thats yours at ROCK bottom payments and almost nill in interest. Rent the home the rest of the year and presto.

Eventually you will build a great patrimony.

They most likly will get sued. After ALL it's not just the Porn business that is high risk... One that comes to mind is The Travel Ind. and many more... So yes as we talking about it you better believe the Lawyers are VERY VERY busy...

One big thing about the Porn Biz is most of the people in it are like a bunch of New York Jew's... They can't agree on a fucking thing. (and no I DO NOT dislike Jews). So they will not be bring any law suit... And regardless of what you big pay site owner think..... This is bad what they have done... Just wait and watch.. This not the end of it by any means...

And you God Dam better not cheat on your Tax'es any more, because the IRS will be getting the same reports that the ccbill's, and ibill's send to Visa...

I have to say that raising the cost of a Visa subscription by $10-$15 makes sense since they are going to increase our cost.

Visa has not said that you have to have a corporation. We can use any person's SSN. We just to have documentation and a letter from the webmaster certifying they are a US webmaster.

Currently (nor do I know of any laws) That will require 3rd party billing companies to report revenue to the IRS. That is your responsibility

I'm not sure about other processors, but this morning I e-mailed CCBILL and told them I wanted to charge more for the VISA signups than the rest. CCBILL says that can't break them out that way. I countered with it's a simple programming script, all VISA cards start with the number "4".

Anyway, I raised my prices 50% this morning. Have to start collecting money to pay the new "rent".
