How To Set Up A Nevada LLC?
 
To put it simply, if you're outside the US, and not a US citizen, what's required, and how do you go about setting up an LLC in Nevada?

I have done that. But those people are trying to sell you something, and I'd rather hear a neutral, informed opinion before jumping in.

Here is the answer.

What you need is a residence in Nevada. Submitt your articles and tax id to the Secretary of state.

You could do it as a foriegn LLC doing business in the state of Nevada.

Most banks now because of 911 have tough rules about foriegn LLC's

Then I would recomend a lawyer to set it up for you.

Thanks, Paolo. I'm looking at something like http://www.incorporate.com to handle it. A third party seems the best way to handle it to get it done on time. Has anyone here outside the US gone down that route before?

Depending on what country you are from all you may need is a Valid passport to get your tax ID #.

I am hearing some more talk that this will not be so bad at least for Canadians, but if you are from sompelace considered to be even more dubious than Canada you may be in trouble.

first, you should decide if you need a nevada llc. each state has pluses and minus, different tax advantages, legal advantages etc.

Nevada is famous because it does not have an information sharing agreement with the IRS and they have a lot of laws for secrecy and even more or less have "bearer shares" to veil the true ownership of a company. to do all that, you need an attorney.

there are many "agents" "attorneys" and other "specialists" that are in Nevada to help facilitate this. a lot of them are scammers.

the best advice i can tell anyone is this:

DONT BUY A SHELF COMPANY because it is cheap, fast or convienent. you have no idea what pending legal actions are against that company, what its history is, whether or not it was a front for selling illegal weapons to third world countries... or how much money it may owe to the IRS.

you have to form a new company.

I can help with Nevada -

While you do NOT have to be a resident you do have to have a resident agent - I have a firm that does mine I can hook you up with - cost is $125 a year and no state income tax so if you bank there you only file federal - I can also supply (for a small fee) all the necessary legal documents to open a Nevada corp.

Also Deleware is another good choice -

Oh someone mentioned banking - and they are right - I use BofA and post 9/11 you can no longer get an account over the phone - lucky for me I had three accounts there prior to 9/11 - to get an account now you must go to a Nevada branch - May require a visit - like attend one of the shows there! - I may have local contacts to help with banking etc.
