Iriondo's family was awarded nearly $50,000 after Delgado's insurance company admitted he had been driving too fast.

A ruling on Delgado's claim is expected Wednesday

I am not sure on the logistics of this exact case, but something similar happend in england.

A boy was crossing a motorway near where he lived and a bike hit him. What the boy was doing was very wrong as you should never cross a motorway and is against the law. The motorbike hit and killed him and the driver suffered serious injuries.

He sued and got damages and won the case.
Now what has the driver done at fault? Why should he have to suffer for his damages to his health and his bike when he has done 100% nothing wrong.
Its a tragedy yes, but the biker did nothing wrong(but theres a lot that hasnt been said, did he have lights, was he in the middle of the road etc)

In a case like that I would agree 100%, and I feel this story may have similar lines. Riding a bike at night for example.

Unfortunately...we live in an era where people try to establish themselves as a victim for monetary gain. Lawyers, judges and politicians have nurtured this environment of entitlement.

Okay, so the kid was wrong for riding his bike at night without adequate safety gear. He paid the ultimate price.

Not to side with the dead kid since lordy knows I've seen a LOT of dumbass people doing reckless things on bicycles - but its adding insult to (fatal) injury for this clown to pursue the kid's grieving family for compensation for his vehicle.

Driving too fast wouldn't have made a difference....in getting the kid killed.
Drive over a bicycle with 80Km kills you as well.....

That said the driver has no legal grounds to claim damages as he commited
a traffic violation at the time of the accident.....Apart from the fact that he's
an idiot for not having an ALL RISK insurance policy on a brand new Audi A8

in another article i read the courts found both parties guilty and as you can see the driver was not charged with anything. his insurance had to payout 50k for killing the kid from, if i remember correctly, a civil suit.

why shouldn't he try to sue for damages to his car then? seems only logical since both parties are at fault.

I read about tat one, the biker got completely fucked, glad he got the compensation
