Can you sue a mentally ill person?
 
Lets say Nats wants to sue Keith for all the lies and bullshit he's spreading around and it goes to court it will come out that Keith has a mental condition what causes his disturbing behaviour. How does that work exactly. Can he get away with it because he is sick?

No, I think that only applies in court to police charges and prison, like they go a mental facility instead. Im not sure though...

In a civil matter, I dunno. In a criminal matter if they're nuts, they're off the hook...pretty much at least.

It would suck though if a nutjob could spread shit about you, be found not guilty due to insanity reasons, and leave you with a damaged reputation and no recourse.

Of course it will, even if he commited a serious crime.

In this case he will be taken to a rehab or something but they will be very hardly able to get any compensation.

You can always publically state that the person that claimed anything against them was officially confirmed to be mentally ill

10 more years and the legal system in the US will consist of a prosecutor, the defendant and his attorneys, and a judge presiding over the twice weekly aired trial (two hour opening show, 4 hour finale with highlights, and all the other shows just one hour long), all for the benefit of the jury...a TV audience who'll vote guilty or not guilty...over the course of a two month period to best monitize ratings and advertising dollars.

he's not nuts enough to get off the hook on anything - he knows what he's doing, we haven't gone that far that we let anybody with any mental problems get away with anything they want, i'm sure his attorney would try it but it wouldn't help much.

If he honestly believes in what he is saying is true, then it would be hard to win a lawsuit against him. You yourself keep pointing out how ill he is and it is possible he does not even realize he is ill. You would need to ask a lawyer about about this.

Dirty F claims he has proof that Keith is mentally ill. It is not that hard to prove that you have a mental illness. You just need a doctor or a shrink to say that you have a mental illness. For all anyone knows Keith is seeing a doctor or a shrink. Most people with Tourette's do not cuss. Those are only the extreme cases. They usually have ticks.

Im no US law expert but being diagnosed as mentally ill and not accountable for your own deeds legally isnt the same here, I doubt it is in the US.

In the US if you can prove you are mentally ill, you usually are not held accountable for your actions. If it is a criminal case, you will be sent to a hospital or the prison psych ward. Here when you are mentally ill you can not be forced to seek help unless you are a danger to others or yourself. So there are a lot of people like Keith.

Same here, you have to proof someone is a danger to other or themselves. Still trying to get away with murder claiming you think god is an oreo cookie is pretty hard here. Weve got something called TBS which means prison but psych treatment and youre basically (cause thats the translation) "owned" by the government. You cant do shit. But just claiming insanity and getting away with prison is barely possible here.

Jane, This is not entirely true. There are degrees of mental illness in the USA. The defendant must prove that he/she does not know right from wrong to be absolved from all actions. Then the person would be locked up for their own safety. A mentally ill individual can still be held accountable for their actions as long as they know what they are doing and the outcome.

It's the most well thought crazy comedy I have seen in AGES! Disturbing in a way!

I was totally amazed, one of the Coen brothers actually worked on the script.

They almost banned the distribution because they put there a very rough parody on the huge companies such as Coca Cola or Starbucks.. Seriously recommended! :thumbsup

Yes that is true. There are different degrees of mental illnesses. I was talking more about Keith. If he is ill I really do not think he knows it. I looked up the illness Dirty F says he has, and it says that most of the people with this illness do not know they have it. It also said that medication and therapy do not not usually work for treatment since it is a personality trait. I feel sorry for him since a lot of people are mean to him.
