Did any of guys ever licence a song for a porn video trailer?
How much did it cost? And what are the quirks?

It is possible. http://www.ascap.com/weblicense/ The minimum fee is $288.00 per year. They will also want proof of your financials, revenue statements, and so on. Because they usually get a percentage of total revenue. I would advise against pursuing this, though. Find some original music that you can license, library music, a local band that matches your "sound" and thinks it would be cool to promote themselves that way. If you try to do this (license a popular song), approval will be required not just of the publisher (ASCAP/BMI/SESAC), but also of the writers and possibly the performers. There are several types of licenses depending on what you envision using the song for. The one I linked is for experimental webcasts, and limits you to using :60 seconds or less in one intro or movie scenario. Major pain in the ass, IMHO. If you go forward, please post and let us know your experiences. Also, as way of warning, if you DO this, they WILL check your site. And if you have any other unlicensed material, even by mistake, they can and will take legal action. If you have a movie scene that has a radio in the background, and they hear a song over that radio, they will come looking for more money. |
We are paying something like 1200 USD a year fix to have the internet rights to publish licensed music.
There is no other way out as we have the whole club area under the cams and of course you cannot play royalty free shit to people or they would probably kill themselves. It's a complete different legislation though.. |
there are sites that have royalty free music. You can loop it with software or mix it with others.

Yes, Carlos is licensed for mechanical, it sounds like, not synchronization.
Using library music in a club wouldn't work at all. Carlos, did you have to obtain any other licensing to rebroadcast anything, or is your setup streaming only? Are the publishing companies the same for what you're doing? Harry Fox Agency, SESAC, BMI, ASCAP? |

The other rights are incredibly expensive and we don't play any licensed music on private rooms where hardcore action happens. As I was trying to calculate once, to get the license to publish one DVD with licensed music would cost a fortune, I don't want to bullshit you but I guess it was around 6 EUR / 10 seconds so say 6 k USD for 90 minutes, speaking about DVD rights only, not TV. That's where I found out why in so many porn movies is such a horrible music in the background, now we don't play anything in the background when there is hardcore action - it has a better raw feel. |

There are some more modern sounding libraries now, that I find useful, but nothing would be cooler than to use all the original songs and artists. |

There are also many Indy bands that are happy to let you use their music just for credit on the video. We have used music from all sorts of bands on both our Adult DVDs and wrestling DVDs. I just hit the bands up on MySpace :)
