Filing a Small Claim Out of State
 
Anyone had experience with this? I'm in Illinois and got ripped off by a company in Wisconsin (about an hour and a half from me). It's for $1100 and I have unbelievable proof of everything. I was just going to chalk up the loss but the whole thing has me so pissed off.

Is there anyway I can sue them in small claims court? And if so, where would I do it? I wouldn't have a problem driving up to Wisconsin for this but would prefer not to have to go anywhere. Anyone had success winning a claim against someone out of state?

How would you expect to win if you won't appear in court?

You will have to get them served by their local sheriff most likely, but you will still have to appear in court.

Of course, you could say it happened in IL and hope it isn't overturned due to a venue issue.

I would appear in court. They are up near Milwaukee which is about an hour and a half drive from me. It would give me an excuse to stop at the Cheesecake factory too.
