Signing non competes to work on projects

how many of you have done it? i won't do it, in fact i was discussing with a family friend and attorney and he told me in many states you can't even enforce them. mostly california and new york. just curious.

yah NDAs aint shit. to this day i have signed 100s of them. thats a common sense thing when dealing with people. NDAs are not enforceable either in a lot of cases, but i will sign them. NDAs don't try to put you on the street or stop you from putting food in your mouth when you end your relationship with an employer.

:2 cents:

exactly... Who's to say someone doesn't try to snap me up just because they don't wan't my competition... an NC is something I would never sign.

You should never sign one as an independent contractor. I can see signing one on a salary job that just says you can't bring your clients with you should you leave the company though.

I have had two signed before, both on hobby store buyouts. Last thing I needed was to buy thier lease, thier old inventory, a name I would change, and well give them a bunch of cash so they could just copy thier customer files and re-open shop without a reasonable amount of time passing.

yah, i've never been asked to sign one, i normally don't ever even work under contract because i don't take things where i don't trust the people that i work with on something. this hasn't always been in my favor. i've been fucked a few times. you learn as you go.

before anyone gets any ideas, there's nothing goin on with me an shane's world.

i was asked to be a part of a mainstream venture because i am getting pretty good at seo and they are asking me to sign non compete.

i'm not down with it.

When I was a recruiter, they would make you sign them and they could wipe their ass with them. They cant stop you from earning a living in your field. The precedent in NY was a Merill lynch broker took his client list with him. Merill said that belongs to us but a judge said if it wasnt for the brokers actions to get those clients Merill never would of had them so they are his to take.

ahhhhhh that explains why. they were going to give me access to a client list. (this would have been on the side in the evenings anyhow) not enough to pay the bills.
