Who is up for a class-action suit against megarotic?

Remember you will most likely need legal money up front.

Who is in?

Phil 11-21-2007 08:37 PM

isn't that German guy in Hong Kong?
where u going to file it? california?

Brujah 11-21-2007 08:44 PM

Any company that is proudly sponsored by our friend at Adult Friend Finder, is legit enough for me. :)

Despite what you think, you can sue people in other countries. It doesn't make it easier, but it can be done.

http://www.megarotic.com/video/?c=premium

That is an open and shut case if you ask me. They are making money off something that clearly isn't their to sell.

RudeBoy 11-21-2007 09:05 PM

I dont think so it's free porn

Iron Fist 11-21-2007 09:09 PM

The thread title sounds like "So... i'm bored, wanna go sue someone we don't like today?" - any caselaw on the books for this sort of thing? Is it even winnable? Are they located in a country that doesn't give a fuck?

If your trying to be serious, then let's get a serious thread going here... otherwise....

Who cares.

Well I can sue you for no reason tomorrow. Companies can sue John Doe based on IP address. The question is what are you getting in return? Privacy in Hong Kong is probably different from what you used to. I’m not trying to decoupage your efforts, knock yourself out, but there are reasons why most successful and vicious spammers live in countries like Hong Kong, Russia, the Ukraine..

And AFF is making money off of the people who are involved with illegal activities. Why not sure AFF too. It is their only sponsor.

JD 11-21-2007 09:12 PM

Great point.

WiredGuy 11-21-2007 09:15 PM

Find some grounds to stop their cash flow and they'll close up shop, its much easier and cheaper to do than getting a class action suit.

Leave AFF alone Will. Jay uses AFF on his sites. AFF is a stand-up company. If AFF supports Megarotic and is their primary sponsor, it must be Ok.

More like 10 years. Jay must have missed that back in 97

DaddyHalbucks 11-21-2007 09:43 PM

Sounds like a good project, but I don't have standing.

pocketkangaroo 11-21-2007 09:44 PM

You most likely won't be able to do shit if he's in China. Therefore I'd target his sponsors (which there is legal precedence for) and potentially the processor and hosts.

CarlosTheGaucho 11-21-2007 10:06 PM

US lawsuit against China?

Don't think that would work BUT, as far as I know pornography is illegal in China.. think from the other end - theoretically they could get busted by the Chinese government (if they really are in Hong Kong)

Any lawsuit like this would be a very interesting precedent for sure..

kovacs 11-21-2007 10:23 PM

It's probably triad or serious government business

I like how you think...

AFF deserves to go down as well for underwriting content theft, if that is what is occuring.

Stand up Jay, You have what it takes .. Money, name.. well your name wont mean shit outside adult webmaster community, but I dare you to do it.. I will contribute to your legal fund.

Snake Doctor 11-21-2007 11:18 PM

I couldn't join the "class" because I don't own any content and therefore have no cause of action against them.

I would however be supportive of any type of "legal fund" that was put together for this purpose after the case was filed. :thumbsup

BareBacked 11-21-2007 11:32 PM

I can not post URLS but its
en.wikipedia.org/wiki/Kim_Schmitz who Jay is thinking of. I have no idea if he owns it but he had a cool website back in the day and was active in the gumball 2000 stuff

Casa Nova 11-21-2007 11:40 PM

this will never get done. It never does.

kovacs 11-22-2007 12:46 AM

Despite the whole content theft thing you've got to have some respect for guys who can push something to that level.

Deputy Chief Command 11-22-2007 03:06 AM

hmm the fact that he is in china and operates a porn site is enough for chinese law to arrest/ convict him I tought ?

Pornwolf 11-22-2007 03:17 AM

I'd prefer to send my lawyers Leroy Brown and Andre Jackson of Smith, Wesson and Rutger LLP.

Pipeline Q 11-22-2007 03:35 AM

There are SOME adult companies who agressively persue this sort of thing, but we are really relying on them. Most likely nothing will ever be done.

I would be interested in contributing to something like this. Not able to join the class action part.

In other industries I have worked in we have lobbyist who try and get laws changed to protect our interests. Has anyone thought about something like that or contributing to the ones that the regular movie and music industry have?

thonglife 11-22-2007 04:04 AM

Dropping them a line about the illegal porn operation they have running.

Actually it's not "IN" China, it's on the bottom of China. :1orglaugh

Amazes me China allows it I always thought porn was a big no no there.

At the recent Prague show I bumped into the Commerce Gate rep, the billing company for Megarotic. She said they had some problems with Megarotic but have now been assured the content is legal. After asking her if she was joking she said no they had been assured it was all legal.

What we need to do is keep hitting them, their hosting companies, Commerce Gate and everyone else with DMCA's until something gives.

It's cheaper than lawyers.

They have a site with legal content and payweb does their billing and it is called megarotic...and I suspect it will soon be their only site as the user uploaded content site built the traffic for their legal content site.

hateman 11-22-2007 07:10 AM

why dont you just hire a hitman?

should be much cheaper.

ServerGenius 11-22-2007 07:10 AM

CommerceGate billing (NOCREDITCARD.COM) is processing for them......a lot
of adult companies use NCC for phone billing and such.....I'd first put pressure
on them......CommerceGate is the number 1 choice for processing when you
have illegal content.

madleinx 11-22-2007 08:36 AM

Makes far more sense to sue the sponsors. Granter, megarotic will get new ones, but sponsors may be a bit more wary of where they get their traffic if there is a judgment in your favor. Far more winnable to stay in the States and certainly more collectable. :2 cents:

kenny 11-22-2007 09:41 AM

Suing somebody in China will prove to be an uphill battle just to win the right for a court to hear the case.

Then even if you win by using some long arm statute and get a judgement or whatever it will be another uphill battle to enforce it.
