You're at the mercy of judges. One of the wisest rulings involved a guy who apparently planted a camera under a grate and got upskirt shots. When caught, his defense was basically, "the women were in a public place, and you don't have an expectation of privacy when you're in public." The judge pointed out that while a person doesn't have an expectation of privacy in a public place, we all have an expectation of privacy under our clothing.

"...In the other case decided yesterday, Glas was arrested for taking pictures up the skirts of two women at a Union Gap mall in April 1999, according to court documents. The women -- one working at Sears, the other at a cart in the mall -- caught him crouching next to them as he snapped photographs using a flash..."

You think it was the flash that tipped them off? :)

All the voyeur photographers should move to washington state.

What makes this such a big story is that you cannot be arrested for getting upskirt shots.

It's legal...due to a loophole in the law.

Of course this was discovered by someone getting arrested for it but that person who was arrested was the pioneer who was willing to put his ass on the line to luckily show everyone around the Washington that what he did was in fact legal....not against the law according to the way the law was written.

Add to his the fact that when I watched the report on the news regarding this.....they clearly stated that Oregon has the same law written the same way which means it's legal in Oregon too.

This means good times for me!!
