PHOENIX - "Un-fucking-believable." That's how JM Productions owner Jeff Steward described the government's motion to dismiss all charges against him and his company for lack of evidence.
Kenneth Witten, representing the US Department of Justice, moved this afternoon to dismiss six counts of interstate transportation of obscene materials by common carrier and three counts of engaging in a business of selling or transporting obscene material.

jesus the law is ridiculous - the owner of JM Productions himself under supoena handed over the records of the sale of the DVD's to that retailer - simple case. but the judge bought the defendant's argument that the only way to authenicate those records was for the owner of JM Productions to go on the stand and say they were - which of course he isn't going to do cuz it's going to incriminate him - what a dumb Catch-22. Why couldn't the government supoena the retailer to authenticate that the DVD's were sold to them? Why couldn't the governmen subpoena a salesman or even a shipping guy from JM Productions to testify that the DVD's were ordered and shipped?

crazy to me - nice break for Jeff Steward and I'm glad - shouldn't be any obscenity laws in the first place.
