Legal Question : Surfer-Submitted Pics
What's the current legal stance on this? How can I safely integrate this into a site without worry of legal hassles?
Here's what I have in mind: - Legal and get out clause on pic submit form - Notice that pics will be removed upon owner's request Ideas? |
Anyone have an answer to this? There are dozens of sites with surfer submitted content. I've look at this in the past but always strayed away from it. Can it be done legally, safely, in the current legal climate?

Hmm. I would think that in the long run, it will be subject to the same laws.

Right now I allow pics but they have to be clothed, not sexually suggestive, and the subjects be 18 (and look 18) at least. A lot of my favorite sites get away with the most hardcore submitted images. I'm probably safer with the way Im currently doing it but just seeing if anyone knows anything. Maybe we've even got a webmaster or two who owns such sites?

That said where you are located has a lot to do with how this could be answered. |

I would consult a lawyer. With the new 2257 rules coming in, there is no easy way to say what does and doesn't require 2257 documentation. Full clothed girls kissing or showing their ass might actually require documents.

My understanding Kristian is that when a model has their picture(s) taken and is sold to another, that the right to use such is passed on... There is nothing wrong with giving a short statement on who the model is... however since it is not X rated... I do not see a reason to have a 2257 statement....
I also understand that as soon as you post porn "actors" that you will need your 2257 link to your 2257 document... The 2257 document has the following: 1.) A hyperlink from you main page with a link saying 2257 ( read your new 2257 rules for the full text required for your hyperlink... ) 2.) A statement stating that the "actors" are of legal age at time of shooting and have given their consent... 3.) A statement indicating where to find the "custodian of records". If this is you then indicate your street address... If it is someone else the indicate their address... And after you have done the foot work then get some legal as to check over your 2257 documentation... Later, . |
Makes me wonder, a well known solo girl site has a forums in the memebrs area and there is an area or just general porn ramblings her members post and such of naked 'finds' on the net, I bet that could be some serious issues as well

Look to a pretty damn famous and not to mention very old school user submitted tease/naughty/risque voyer site on the web. They also have a very unique little logo, you almost always will find a version of that logo in every single picture of video.
I do not wish to just say do this and that. There are a lot of legal loopholes and requiements. I am not a lawyer and I sure and the hell am not a paid consultant. |
Expect to get a lot of copyright complaints as membership content often finds its way there....some times innocently and sometimes not.

I appreciate the replies guys. This is pretty much what I expected but I like to run things by the folks at gfy if only to confirm my beliefs. That sounds pompous, but not meant to be - I learn a lot here too and have in this thread.
I think the less stressful thing for me to do is stick with my current system. As mentioned I only accept clothed and images that are not sexually suggestive. They also need to make sure no one else is in the pic and agree to being over 18 as well as looking over 18. |
