Have you ever sent a DMCA notice?

(those that rely on stealing other people's content don't need to answer for the obvious reasons)

I find it more and more often people get all confy into using what isn't theirs...tskk tskk :disgust

AaronM 09-16-2007 09:14 AM

Yep....I've sent out one or two over the years.

Your attorney should have one handy.

Here's something I sent to Megarotic to get my shit off their site:

1. Specific identification of the copyrighted work
which you are alleging to have been infringed. If you
are alleging infringement of multiple copyrighted
works with a single notification you must submit a
representative list which specifically identifies each
of the works that you allege are being infringed.

The scene RealDoll Stefane and Steve Awesome on bed is
being hosted in its entirety on your site. Please
remove. A sample shot from this video is here:

http://realdollsex.com/images/320x24...nielove002.jpg

2. Specific identification of the location and
description of the material that is claimed to be
infringing or to be the subject of infringing activity
with enough detailed information to permit us to
locate the material. You should include the specific
URL or URLs of the webpages where the allegedly
infringing material is located.
Information reasonably sufficient to allow us to
contact the complaining party which may include a
name, address, telephone number and electronic mail
address at which the complaining party may be
contacted.

"Fucking Doll"
http://www.megarotic.com/video/?v=5A9QLEPD

3. A statement that the complaining party has a good
faith belief that use of the material in the manner
complained of is not authorized by the copyright
owner, its agent or the law.

RealDollSex.com is the exclusive distributor of this
content. I am the copyright owner and the male model
featured in this video. You are not authorized to
host this content.

4. A statement that the information in the
notification is accurate, and under penalty of perjury
that the complaining party is authorized to act on
behalf of the owner of an exclusive right that is
allegedly infringed.

This information is accurate and I am the owner of the
content that is being infringed.

Thank you

They never answered, but the video no longer works (the page comes up -- it looks like they simply pulled the data file). Half assed, but good enough for me.

I've had to send several to Ebay.

They're form isn't exactly a DMCA form, it's their own. But for anyone who needs it....

I received a DMCA notice when I was running an ISP years ago. The lawyer seemed surprised when I informed them that Australia was not a state of the USA. :1orglaugh
