Bodog Poker website Siezed in court Judgment - bodog.com was snatched!

Apparently, some guy in the US who was awarded a patent for something to do with taking bets online filed a lawsuit against Bodog awhile back. Bodog didn?t respond because they are not a US company. So a judge awarded a default judgment of 50 million.

Yesterday, the guy with the judgment used it to seize control of Bodog?s domain names from Enom. Almost all of their sites are now offline, and now they are going to loose all of their SERPS.

This is a webmaster's worst nightmare. See how wrong things can go: http://www.bodog.com/

All I have to say is WOW.

We have judgements against a couple of the foreign infringers we sued. Not Bodog. One of them posts here and can run but can't hide fyi.

Welcome to the new (temporary) Bodog. As you may know by now, Bodog.com is experiencing a technical issue impacting our players' ability to access our website.

This is the result of a legal dispute over the ownership of the Bodog.com domain name. We are fighting this dispute. We are confident that we will win, but until all is settled, I do not want our battle to interrupt your play.
So, I present you with newbodog.com. You won't notice very many changes: same website, same brand, same product, and same service. Just a new domain name.

We are working to resolve any remaining issues on the temporary site as soon as possible, and fully expect to have our original site back up shortly.
I sincerely apologize if you were affected by our interruption and assure you that I will update you soon.

Regards,
Calvin Ayre

another example of patent abuse run amuck and costing someone a lot of hard work on a bullshit technicality.

hey if you can't build it yourself, just steal it. I don't know why the hell bodog wouldn't have changed their registrar to a non US based one if they knew this was coming...

Actually, you have to remember that all registrars work under the approval and guidance of ICANN, based in the US. Technically, all domains are registered in the US and could be seized, or potentially even the entire registrar until they turn over the domain in question. Very, very few people have gone down this road, but the potential is there.

They can run. They cannot hide.

RP Fade 08-28-2007 06:38 PM

I saw them heavily advertising whenever I watched poker on TV..

Wasn't there a dispute recently in which a US court ordered the piratebay domain be turned over in a similar matter for a lawsuit that was not contested? If I recall correctly, the Canadian registrar basically said "doesn't apply to us in Canada, sorry" and ICANN said "not under yours or our authority, sorry.".

Am I mistaken?

NinjaSteve 08-29-2007 08:13 PM

Pwned! And that really sucks balls for them.

crazy shit...

LiveDose 08-29-2007 09:13 PM

Damn that sucks for them.

SmokeyTheBear 08-29-2007 09:21 PM

i cant believe the new bodog owner is just letting it dead end instead of selling the space.

WiredGuy 08-29-2007 09:22 PM

Wow, the new owner should at least start pointing all that traffic to a PPC landing page, gambling traffic is worth a ton. As for Bodog, they were pretty stupid to just ignore a suit like that.

matrix_x 08-29-2007 09:25 PM

Whoever now owns Bodog.com is an idiot - they could have a few gambling affiliate links to other poker rooms & sportsbooks and be making a fortune!

will76 08-29-2007 09:30 PM

I am surprised someone can hold patent on something that is considered illegal.

Isn't online gambling illegal?

Not sure, but there is this, more than 5 years old:

http://www.theregister.co.uk/2002/09...r_domain_name/

The .com registry is based in Virginia, and at least for cybersquatting and copyright infringement cases to do with domain names, apparently that is all that is required. ICANN appears to be trying hard to say that there is nothing they can do, but I suspect that with enought pressure, the .com TLD could be forced to deal with non-responsive registrars, or potentially discontinue their registrar status. The agreement clearly states that the agreement is subject to the laws of Virginia, USA.

http://www.icann.org/tlds/agreements...08-01mar06.htm

Actually, I am more surprised that some smart lawyer hasn't gone after the .ORG registry for allowing thepiratebay.org to exist, considering it is certainly not a non-profit organization.

woj 08-29-2007 11:17 PM

damn, that's fucked...

DatingGold 08-29-2007 11:49 PM

I'm not too sure Enom was in the right there or being able to use the judgement to collect like that. They aren't a US company, he should have to collect from wherever they are.

Trax 08-30-2007 02:31 AM

all they should have done is send a lawyer to show up in court
they would not have had a problem... easy as that.

Manowar 08-30-2007 10:07 AM

That's horrible for the bodog company, damn

Online gambling isn't illegal, it's all over the place -- licensed fantasy sports leagues and off-track betting on horses, and even the sale of lottery tickets online, where lots of money goes to the state. Online gambling is ok when the state makes money, but it's illegal and "immoral" and a "serious problem" when it's not taxed. It's just that pimps get mad when they don't get their cut.

Violetta 08-30-2007 10:41 AM

shit what a nightmare that must be.

thehand 08-30-2007 10:41 AM

Thats crazy, I was just watching their "Battle of the Bands" reality show.... I guess they are fucked!

djroof 08-30-2007 10:43 AM

this is bad for a huge gambling company....

~Ray 08-30-2007 03:58 PM

I wish I could slap an affiliate link up and redirect it... yummy

channel69content 08-30-2007 04:12 PM

Worst possible timing to with football season starting this week... As a long time player at bodog I must say the poker tables have been a little slow, however everything is still running. Many of the guaranteed tournaments have been pulled off the board though. Im interested to see how this one will play out. If Calvin steps foot in the U.S he will be immediately arrested, so how they will go about fighting this is beyond me…

Niktamer 08-30-2007 04:33 PM

ouch big time traffic loses..

New owner is damn stupid to no monitize this...

damn .. now i wanna play poker :)

EPGScott 08-31-2007 12:16 AM

They can't put anything at all on that site as it is against the law.
Right now all they can do is leave the site blank until Bodog pays them the 11 million they owe. The remaining money is for future royalties to the company that won the lawsuit.
Basically Bodog can buy the domain for $11,000,000 if they want it, if not the company will just keep going to court and taking which ever domain bodog is using. The company that filed the suit had the rights to online gaming in some form.

Hope that helps
EPGScott

I'm sure he has millions laying around, 11 million is nothing to that guy. He is probably negotiating. I don't see why. Every day that domain is down, he is losing mililions.

Varius 09-19-2007 12:09 AM

Anyone here remember Calvin Ayre came to one of our Costa Rica Bash parties last year and had bunch of shots with us ? :pimp

Sucks for him, I hate people who take any little thing to court or sue people for looking at them funny.

collegeboobies 09-19-2007 12:37 AM

This will not hurt them so bad. The dedicated players will find where there money is and gamble there. They are already back up with a new site and can no doubt have more protection now hopefully not US registrar. Basically the big money players which is biggest % of profits will find the site.
