WHY THE FUCK is my divorce lawyer reading me my info from CCBILL??
I want to know WHY THE FUCK
1. A FULL copy of the contract that was signed between me and CCbill was provided to my wife's attorney. 2. A FULL record of ALL of the money that I made from the beginning of the website up to now. 3. WHY THE FUCK DIDN'T CCBILL NOTIFY ME THAT A REQUEST WAS MADE FOR MY INFORMATION OR THAT INFORMATION WAS GIVEN? Now I understand that information gets provided due to subpoenas and things like that, but how in the world could the court prove that the site was mine in the first place? there wasn't a picture of me anywhere on the site. there isn't any reference to my real name or anything on the site. When you do a WHOIS database lookup, the information is fake..so how the fuck did they get enough to get a subpoena in the first place? Can a court just subpoena anybody they fucking want to without regard and the information be given. When my lawyer was reading off my payments, my heart dropped. I'm just pissed that I wasn't even told about the shit by CCbill and not looking like a dumbass when my own laywer gives me the shit. Thanks to this, I will have to get another processor for my site. One that won't lie down for some bullshit and not even notify the webmaster about what's going on. But I can't drop ccbill do to my recurring customers. I'll be gotdamned if CCbill will be giving away all of my info without telling me anything. Thanks a lot CCbill. and if you want to know my account #, icq me at 120838664...and i'll be on the phone with you in a little while anyway. Any processors that want to process for a new site and won't give out information about me WITHOUT AT LEAST TELLING ME AFTER IT HAPPENED, get at me....I'll be making the change in a few weeks. |

It's all well and legal, if they were asked to give your information for divorce proceedings... And they aren't obligated to let you know either... It's the basis that you're supposed to be fucking honest with #1, your lawyer, and #2, your wife. Half of YOUR SHIT IS HERS... if you weren't willing to accept it, you shouldn't have married her ass. |

Community property laws... possible alimony renumerations etc etc all tilt for the one sueing for divorce and then the counter claimant. All they had to do is subpeona ANYone in this trade that could possibly be doing business with you and *if* that entity has information on you, oops. They are required to hand it over in full usually. If they don't then obviously they don't have anything to turn over.
Like someone said ccBill doesn't have to nor will most companies, notify you that they were served and complied. That could draw them in to the litigation possibly. Thats not public relations, its the way it is. And to top it off, you'll be forfeiting your domains once netsol gets into swing on the whois dbase information verifications, unless you get them changed over to legally correct information before they get to yours. :winkwink: |

The information would be relatively easy to gather as long as she knew your domain name. If she didn't know your domain name I'm sure she could have gathered that from a friend or associate.
Domain Name => CCBill Account => CCBill Account Registered Owner => Owner Verified=> CCBill is served with an order=> Account Info. |

look man I'm already fucked. I just got off of the phone with ccbill...apparently, my wife's lawyer convinced the court somehow so that he could get a subpoena. Either way, all of my child support payments (if any) will be calculated off of my website income. 25% of what I make can pay her rent and some bills to boot.
it seems like ANY billing company that is served by a subpoena, regardless of what basis it has, MUST turn over the information to the party, EVEN IF the website owner didn't commit any kind of crimes. So even though CCbill was required to give out my info, I'm still pissed that I wasn't even notified and I now MUST change my billing company before the divorce is finalized. Thank God I can prove that she is a psychotic drunk who picks up the kid from school with alcohol on her breath. If she was a regular 9-5 sober woman like most others, I'd be fucked because because of the pornography, I would lose custody and on top of that I would have to pay a percentage of what I make from the pornography...how stupid is that? Thank God she didn't subpoena my sponsors. I know CCbill is one of the best processors, but how are folks doing with GLOBILL?? I'm about to do a Michael Jackson and make that "change" |

Rules vary from state to state, but in general - as long as there is a lawsuit - someone can subpoena stuff.
In this case it would be relevant, but you are by no means REQUIRED to turn stuff over on a subpoeana - you can file a motion to quash the subpoeana, but in this case - I think you would lose. And CC Bill isn't going to care - they will just give out the info. I have had my info requested in this manner before - and some places let me know - while some places did not. A subpoeana is usually not signed by a judge - I have done my own before - and when I went to the clerks office - I found out the gave BLANK SIGNED subpoeanas to lawyers, but not to me - but they stamped mine there. Your lawyer should have told you all this. Good luck. |

When it comes to child support, they can take it directly from CCBill or whoever your "employer" is. If you switch to a new billing company & try to hide the information, they will just start garnishing your bank account directly. I've seen it happen to a friend of mine that had no idea until he noticed a chunk of cash missing from his check & had to call to find out what was going on. He was extra fucked cuz he *had* been making his payments, but was giving his ex cash which, of course, she denied ever receiving. |

Just go for the kids. Being with a drunk exposes them to obvious dangers, and if you don't expose them to your business, you have a good shot at it.. unless you live in the country where the bible thumping kangaroo courts could care less about what the mom does and just gives them to her.. No doubt your business will be questioned and probably blown way out of proportion by her lawyer, but it isn't illegal, nor does it present any harm to your kids. Try to get some video of 'Mom' in her drunkened state, or get a few credible witnesses.. Just don't give up. Kids don't need to be with drunk parents. |

I hate to tell you this but you?re fucked. The Lawyer isn?t even using this for child support calculations. He/she can do that with tax returns. They are using this data to generate a cash value of your business. Even in non-community property states the wife is entitled to half the increase in the value of the business during the marriage plus half the goodwill value business. So expect to dole out quite a bit of cake to your wife to buy her share of the business. At this point it doesn?t matter if you switch all of you billing accounts and so on. The lawyer already has your track record of how much your business it capable of earning. BTW: the drunken/drug addicted spouse arguments rarely work in custody battles unless you have a criminal record, and or a history of treatment to back it up. Without more than just your statements it will just come across as sour grapes

I feel for you Playa, I dont know how u did your payroll, (which would be money you owe for support or whateva), but you will basically have to show that you didnt personally profit. Close the site corportation and open up an new one (ex. BVF Enterprise) in a "trust"
