Torrent / Filesharing precedent set: 'Making Available' is illegal.
You heard it right. 'Making files available' is just as naughty as hosting them.

I saw that. Things are finally starting to get interesting. Lots of progress has been made in the past month.

So what they are saying is that if you share a folder or upload music to a website directory, you are guilty of copyright infringement even if nobody actually downloaded it from you. Interesting.
