Mattel Sues ChinaBarbie.com for Trademark Violation
http://xbiz.com/news/83427 NEW YORK ? Barbie doll manufacturer Mattel Inc. has sued adult performer China Barbie of ChinaBarbie.com for using its famous product's name on her website. Mattel filed suit in U.S. District Court in Manhattan, alleging China Barbie violated Barbie's registered trademark by including it in her domain name in a "bad faith attempt to profit from Mattel's Barbie trademarks." The company alleges ChinaBarbie.com, owned by Global China Networks, has damaged Mattel's good name. Mattel has demanded that the domain name, which is registered with registrar GoDaddy.com, be transferred to Mattel and that China Barbie pay the company up to $100,000 in damages as well as any profit she may have made via her paysite. China Barbie charges members $19.95 for monthly access to photos and video clips. Mattel Press Contact Sara Rosales told XBIZ that the company will not comment until the case is heard. It is unclear whether other adult stars using the "Barbie" name could be subject to future trademark violation lawsuits. As of Wednesday, ChinaBarbie.com was live online. China Barbie was unavailable for comment at press time. |

Back in 2001 I had an amateur submission site and got a nasty letter from them after posting pics of someone that went by the name Barbie. She ended up having to pay them around the same thing they are asking here and changed her name to Blonde Flasher for her site etc. I had to remove all links within 24 hours and she gave them her old domain.
Mattel has always been tough on the use of that name... |

I know this thread is a few days old now, but I just saw it.
Mattel pulled this shit with me a few months ago over my site, www.barely18barbie.com. They sent me a nice little e-mail informing me that if I didn't hand over the domain to them, along with a report of how much the site has made since it's been online, that they would sue the crap out of me. They gave me one week to hand over the domain and the earnings report. I fucking ignored them. One week later, they contacted me informing that my week was up and I had to hand over the domain and earnings report immediately. I fucking ignored them again. I haven't heard back since. That was four months ago now. I'm hoping they just forgot about it. I figured if I e-mailed them back it'd just keep them interested. Ignoring them seems to have worked... for now. |
