Mattel Sues ChinaBarbie.com for Trademark Violation
NEW YORK ? Barbie doll manufacturer Mattel Inc. has sued adult performer China Barbie of ChinaBarbie.com for using its famous product's name on her website.
Mattel filed suit in U.S. District Court in Manhattan, alleging China Barbie violated Barbie's registered trademark by including it in her domain name in a "bad faith attempt to profit from Mattel's Barbie trademarks." The company alleges ChinaBarbie.com, owned by Global China Networks, has damaged Mattel's good name. Mattel has demanded that the domain name, which is registered with registrar GoDaddy.com, be transferred to Mattel and that China Barbie pay the company up to $100,000 in damages as well as any profit she may have made via her paysite. China Barbie charges members $19.95 for monthly access to photos and video clips. Mattel Press Contact Sara Rosales told XBIZ that the company will not comment until the case is heard. In other news, the People's Republic of China announced that it too is suing porn actress China Barbie, stating that her use of China as a first name is a bad faith attempt to profit from the use of a nation opposed to porn.

I actually had my lawyer advise me against registering www.barbiehardcore.com instead of wwwmanmadesluts.com which i ended up sticking with for this exact reason ..

Going through kinda the same thing myself...one slight difference, my site isn't porn.
Although I have had 'Planet Hottiewood" officially registered and now finalizing in the trademark process, Planet Hollywood decided to NOWm after over two years and the name just entering formal registration change, to decide to try to sue 'Planet Hottiewood" They want outright the name, the trademark, everything. They feel it devalues their family name! My attorney says they fell asleep behind the wheel because they had their legal opportunity to oppose the trademark, but they didn't. They now just want everything...just like that. If the US government OK'd the trademark, it's not good enough for Planet Hollywood...so they sue! Funny, a site with bikini and lingerie models is being called disparaging by a company who feeds people fried foods, indulges in gambling, booze and to some extent prostitution! (they know the hookers are there) All said and done, my attorney said I have a case, but it's going to cost me LOTS of money because they obviously have deeper pockets.
