ok this may be a stupid question but given the fact that he refused a breathalizer and his physical disability would hinder his movement doesn't that create a situation in which his failure could be because of his disablitity an not because he was drunk.

Refusing a breath test is an automatic suspension of your drivers license. Its pretty much an admission of guilt.

Definitely true in my state. It's called 'implied consent'. When the state gives you a license, you agree to submit to testing. If you refuse, your license is automatically yanked.

In Arizona it's a law that you sign your life to when you get your license. If you refuse even if you KNOW that you are not intoxicated, it's an immediate one year suspension.

In my state if your refuse a breathalyzer test you lose your licenses and are charged with DUI. No if and or butts. Kind of goes against the 5th Admendment but no one has taken it to court I guess.

What state do you live in? We don't have that law here.
