I think this is about as fucked up as it comes and he's a soldier too. Can't they get this guy for murder? I mean, we don't have a cure, so dude is gonna die or do they have to wait until he's actually dead? Either way, fucked up.

Yes in many places, it's illegal to knowingly have unprotected sex with someone if you're HIV+ without notifying them. As for this particular case, if he's guilty of what he's been accused, then yeah it's obvious the guy's a piece of shit.

This charge however:

"committing a crime against nature"

I do not at ALL agree with and is nothing but homophobic bigotry wrapped in pages of the bible. :2 cents:

I'm pretty sure such "crimes against nature" laws are now unconstitutional and probably won't hold up because of Lawrence v. Texas.

I just don't see how this guy isn't getting a life sentence if he has basically killed this 17 year old kid by infecting him. A few assault charges and crimes against nature is all they get him for? That's ridiculous.

I'm not sure about the state they are in, it varies.

Some states have specific crimes for knowingly being HIV+ and having sex without notifying your partner. They carry VERY strong sentences.

Other states don't have such laws.

I am not at ALL justifying what this asshole did, but you do have to keep in mind, that everyone knows having unprotected sex carries significant possibility of disease. So anyone engaging in that type of reckless behavior is putting themselves at risk. In states that have refused to enact harsh laws, that's been the rational.

Unfortunately, this guy was only 17, awfully young to learn such an important lesson the hard way, and exactly why I'm such a big advocate for proper sex-ed.

After his intervention, he went to rehab and got a test done, he was HIV+...
