If memory serves, a splash/warning page is not required by law. However, it's generally a good idea to have one. If, god forbid, you were ever targetted by the feds and your lawyer needed ammunition for your defense, the splash/warning page could go a long way in showing that you put forth an effort to keep unwanted parties (such as underaged individuals) from accessing your site.
I'm not a lawyer, so please don't take my advice as any legal counsel. Perhaps another, more experienced webmaster will chime in here.
