A federal jury in Phoenix, Arizona convicted Jeffrey Kilbride, 41, of Venice, California and James Schaffer, 41 of Paradise Valley, Arizona of eight counts, including conspiracy, fraud, money laundering, and transportation of obscene materials. In 2003, Kilbride and Schaffer set up a spamming operation to promote pornography sites. They earned $2m in commission from porn site operators for the traffic generated from the emails. Hard-core porn was embedded in each email, which meant that anyone who opened the email could see it. Kilbride and Schaffer did not let the CAN-SPAM Act, which banned the distribution of multiple electronic commercial mail messages containing falsified header information, stand in their way. When the law came into effect on Jan 1, 2004, they simply logged onto servers in Amsterdam, to make it seem like their email came from outside the US. Also, the 'from' names and email addresses were different from the 'reply to' addresses, so recipients could not identify the sender or reply to email. In another violation of CAN-SPAM, the domain names used to send the spam were registered in the name of a "fictitious employee at a shell corporation Kilbride and Schaffer established in the Republic of Mauritius," the US Department of Justice said today. To cap it all, the dastardly duo funneled their ill-gotten gains through the Republic of Mauritius and the Isle of Man to "further insulate themselves from detection by U.S. law enforcement". In August, 2005 Kilbride and Schaffer were the first people charged under the CAN-SPAM Act. They face up to five years in jail for each spam and obscenity offense and a fine of up to $500,000 and up to 20 years for money laundering. They will be sentenced in September. I knew one of those guys well, and he was a hell of a nice guy. Yes he spammed, but he was pretty smalltime compared to several companies that post on this board constantly, buy the biggest sigs available and get their asses kissed here daily when they probably really should be in prison.
Hopefully the sentence will be light, as much worse offenders have been let off with a fine and an 'I'm sorry'. |

no doubt they broke the law but it looks to me like they are going to get as much time as some get for murder. jail isn't the place for them - they should just seize all their assets and maybe a year in jail.

There are mailers and there are spammers. These guys narrowed their lists very very quickly, focused their content by niche and achieved amazing conversion ratios by getting the right emails to the right people. I'm not saying it's a good thing, but if you're going to be a mailer, that's how you do it. Neither one of these guys ever screwed over, sued or robbed a webmaster. A lot of people that are bashing these guys suck up and post in contest threads for companies that fuck over surfers AND webmasters and spammed absolutely without regard for targeting in the most irresponsible and offensive manner possible. If any spammers deserve a warning it's these guys, but it's probably these guys that will get hammered while the real cocksuckers paid a fine and post here every day.

Update on this:
On Sept 7th, a judge denied the defendants try to get the conviction thrown out or for a new trial to be had. On Sept 24th, James Schaffer (aka Diamond Jim) was to be sentenced. I have not found any information on what the sentence was, but he was facing 30 plus years. What surprises me is that nobody twigged onto the fact that the images found to be obscene may have involved fisting. This may also be one of the first cases in a long time where an online porn operation was charged AND found guilty of obscenity. Anyone have additional information? |

Guilty of violations of Can-SPAM, transportation of obscene materials, and money laundering. The money Laundering by itself is up to 20 years. The Can Spams are 5 years each. THe obscenity I am not sure of. 8 counts total, the real "up to" could be 50 years or more done consecutively, which I am sure isn't what happened. I am surprised there isn't a whole big stink about this. After all, the "transportation of obscene material" is a really big deal,essentially showing that moving this material over the net is apparently a crime. I would think that some of the others on trial for obscenity charges are likely NOT happy to have seen this conviction. |
