Max Hardcore Indicted by USA Gov't

http://www.thesmokinggun.com/archive...31071max1.html

Xbiz and AVN both get beaten to the news punch by the smoking gun.

Interesting that they filed this case in Tampa Bay...

StuartD 05-31-2007 12:01 PM

It was only a matter of time... I'm sure the feds have wanted to bust him for a good long time.

headless ghost 05-31-2007 12:02 PM

not good

Digipimp 05-31-2007 12:05 PM

no surprise here, the bad part is when they go after people that are really trying to push the limits and then use them as an example of the whole biz

headless ghost 05-31-2007 12:05 PM

he is 50 years old.
thats a hell of a time for a carer change.

DWB 05-31-2007 12:06 PM

<sarcasm> Never saw that coming. </sarcasm>

Mess with the bull, get the horns. Not a difficult concept to grasp.

Kevin Marx 05-31-2007 12:07 PM

actually, this can be a good thing.. another test of the obscenity clauses... It's tough to prove obscenity, it really is.

Good luck to him.. not my kind of porn, but if he goes down, it's a bad sign for everyone.

munki 05-31-2007 12:08 PM

They are going after Max again?

tranza 05-31-2007 12:09 PM

Damn, he's fucked now!!

:(

pornguy 05-31-2007 12:11 PM

Not surprised.

TarPy 05-31-2007 12:12 PM

this is the video named in the indictment

NaughtyRob 05-31-2007 12:13 PM

Didn't he beat an obscenity charge before?

Yeah I believe so. People always think the worst when someone goes to court

Ramos 05-31-2007 12:16 PM

That's a bummer. He's done a lot for our industry, especially when they tried to go after him for making girls look younger than they really are, which is bs and he won. Hope he can pull thru this. He usually has his shit in order. We'll see......

scoreman 05-31-2007 12:17 PM

Feds are seeking forfeiture of not only his websites but it looks like his home as well. $2M home too....

RawAlex 05-31-2007 12:18 PM

My take:

It sucks to be Max right now, but he has had plenty of warning on this and he chose his path.

The interesting thing in this indictment is the idea of the internet as a tool for "affecting interstate commerce". I always find this an interesting hole in the law. After all, if the server is in one state and a member in another, who actually causes the material to travel interstate? Without the end user, the material would never have gone there. Further, as many large ISPs (such as AOL) share gateway access to the internet, it is impossible to tell who is where until such time that they become a member. Even then, it isn't clear that someone who resides in Tampa Bay is in fact signing up in Tampa Bay, only that it is their billing address. He could be in an internet cafe in belize for all anyone knows.

When it comes to the DVDs delivered though, honestly, he looks fucked. There is very little way to dance around the fact that the videos are in the hands of the feds, having been delivered to Tampa Bay. Goes back to the famous Zip code lists, I think TB was on there a long long time ago. Sending pissing and full hand fisting videos into that area is risky, and unless major case law is made, are fairly likely to be found obscene in nature.

Forfeiture... that is a hard penalty, certainly something I wish on nobody - especially if they move for seizure before judgement, which could effectly put Max right out of business.

Now that surprises me. I have been there, and while nice, I never would have appraised it that high.

seeric 05-31-2007 12:31 PM

they are doing it in tampa because its got a damn church on every corner you look. when i lived there i lived in fear for the entire year because of how fanatical and religious they are. not good for a jury trial there.

PSSuperstars 05-31-2007 12:36 PM

Wow. That sucks about his stuff being ceased....

But it could be good for the industry as a whole if he wins some areas and loses other areas..

changing obscenity from "I'll know it when I see it"... to something concrete...

Sounds like a great place for a porn convention...

PSSuperstars 05-31-2007 12:38 PM

I wonder if HBO/Showtime/Skinemax are going to take down the porn documentary that plays at least weekly on one of them.. with Max talking about how he champions the fight for Aids testing?

The documentary showed girls drinking piss/vomiting.. and that was OKAY to be shown on cable..

So who knows.

i remember a consumer show down there that had tons of picketers and people opposing the consumer erotic show. i'm not sure that there would be any issues with a webmaster one unless the word gets out. i'm sure the authorities will keep tabs on it though.

PSSuperstars 05-31-2007 12:41 PM

Oh.
And how does he even get Visa processing?

When I, as a phone sex company, can't even say the word TEEN on my site or visa yanks me down?

You can put a port-o-potty on a street corner in some parts of LA and it evaluates for half a mil. Nothing is impossible.

I think it is safe to presume word will get out.

CE_Rashaan 05-31-2007 12:54 PM

FYI- NEVER send a PORN DVD by US MAIL unless you want to go to jail, especially to Florida.

About once a month I get a hand written letter requesting that I mail some DVD's to a PO BOX somewhere in Florida or Pennsylvania. Cash is usually included to supposedly pay for the "DVD and shipping". This is a set-up!

These right wing weirdos get your address from 2257 and ask you to send them stuff via US MAIL (federal crime) to districts that deem the material obscene in hopes that you are dumb enough to hang your self....

Unfortunetly some people are....

Me, I pocket the cash and go buy a pizza!

devilspost 05-31-2007 12:55 PM

Tampa is full of titty bars massage parlors and adult video stores, The Penthouse Club is on the same street as the hotel.

SomeCreep 05-31-2007 12:55 PM

Maxworld Entertainment was one of the few companies that chose to fight the government on obscenity accusations, rather than shut down his sites like Meatcash did with pissmops.com and Dukedollars with yellowdiscipline.com.

Looks like he's still knee deep in litigation, but that's certainly nothing new for him.

Bama 05-31-2007 12:58 PM

I hope like fuck he wins and I'm not at all a fan of either him or his material.

But what I can't stand is the powers that be trying to enforce "community standards" inside of a private home. I can understand "community standards" coming into play if one were to drag the TV and a recliner out to the front yard and watch the DVD there - but inside a private residence?

If that's allowed, I can't wait for the day when Jewish or Islamic religions win a battle against any Christian literature or television show being allowed in public that would offend them. With the removal of "Merry Christmas" from many advertising literature in lieu of "Happy Holidays" - or the removal of Christmas trees - maybe that day isn't too far away...

If we're going to enforce "community standards" on one end of the spectrum, it's only right to enforce it on the other end as well.

CurrentlySober 05-31-2007 01:21 PM

Tampa DOES have a porn convention EVERY year... And Its CRAZY... I was there five years in a row !

Yes he has, Ramos. A lot to make it look bad. The guy is a cancer on the industry and while I don't like big brother telling others what they can and can't do, the writing was on the wall and he said "piss on you" to the government (and the girls) and now he'll likely be the one getting fisted.

This will be a very intersting case to watch... put aside the extremeness of the content.. he is being charged with shipping (obscene) DVD titles along with the viewing of (obscene) video clips via the web. (similar to extreme associates case).

I guess Florida will be looking to describe what they consider to be "obscene".

Its hard for me, as a laymen, to understand that a discretely wrapped package, that was purchased by an adult, delivered to the adult's home can be the subject of "obscenity" when it is a private transaction.

Likewise, viewing of a video clip behind a members area, which is not out in the public, is also subjected to what is obscene.

The laws are designed to protect the public, but the person who received or viewed these materials was not harmed, they wished to see items.

It used to be against the law for homosexuals to have sex in the privacy of their own home in Texas.. you would think that similiar such strikings of the law would preserve the personal privacy space. To me, this is a very republican idea of privacy and less government intervention.

Generally speaking, the criteria for obcenity is, if the work as a whole lacks any educational, artistic or political value. If his sites aren't on cms, they can get him for each page that gets deemed obcene as a seperate piece of work too. Very hard to convict on this one. I'm sure he and his lawyer have covered every last safeguard in anticipation of this and likely have a solid defense against the charges.
