HollywoodTGP slapped with Lawsuit
 
"Hollywood Chamber of Commerce and Global Icons Entertainment Licensing" - just slapped me with papers for using "Hollywood Stylized Text and Logos on my site."

It was ONLY the use of the ****H O L L Y W O O D**** style letters on my site.

Going to scan the letters shortly.

I was reading an attactched letter as well saying they had previously emailed me and snail mailed me, but I had ignored them (so they say) I have not gotten an email or letter from them until now.

That letter says I ignored them sorry jumped the gun regarding *lawsuit*

Seems like they are expecting a settlement for past usage.. I'm no expert with law. But I don't understand how they would even have a case, and If the company asked me for a settlement for past usage, i'd tell them to GFY.

When I told them about the Panamanian corporation that owns all those sites (hehe!) they had panamanian attorneys send the same suit to the corporate HQ in panama.... they were advised to give up the doms ... sucked...

The HCC let the sign fall into disrepair and a private
citizen's group fixed it back up and continue to
constantly raise the money to maintain it's condition.

If you are a resident of Hollywood (quick get a PO box)
then you'd have claim to be allowed to use what has
become public property.

Hmmm. are you referring to hollywood calif. or hollywood fla. or where ever else there is a hollywood, on your site? is there a hollywood pa., or a hollywood ohio or others? what makes these people think you are referring to an actual location in calif.? could it be a "hollywood, state of mind" as in a "new york, state of mind"? just some thoughts. please don't sue me billy joel :)

Its more about the copyright or trademark of the <i> STYLE</i> in which <font color="gold"><b><i>HOLLYWOOD</b></i></font> was written.

I fully understand their rights and respect them.

Thats why I took it down.

See if they did the same thing to Hollywood Video cause I doubt they have an agreement. They are just targeting you dude cause you are a porn webmaster.

That and they don't own fonts. You have a clearly stylized logo that is definitely not going to be confused with thier trademark.

I think your problem lies more in the font you used in that you are making it resemble the hollywood sign.

I'm sure if you just used another font you'd be okay...however I'm not a lawyer I only play one when fucking hookers.

I seriously doubt they have a case. Especially if the sign is really maintained by a public group, now. What are they going to claim? Confusing similarity to the real sign? Surfers might think they're really in Hollywood? It doesn't even look that much like the Hollywood sign. I think they're just blowing smoke up your ass.

Oh just so you guys arent confused.

In the letter they mention I use the "Infringing" logo twice.

Under the logo I had a webcam window where I place pics from around Hollywood...

One way to get around the C & D bullshit is to say, and more importantly demonstrate, that your site is a PARODY of everything Hollywood stands for. In essence, you are satirizing the mark and hence not trying to gain from any mistaken identification.

This is a valid exemption, called FAIR USE, to US copyright laws.

You probably would win on the grounds of "fair use," but this is one of those things that probably just isn't worth defending. Change the font and they'll go away. If they don't, take the site down and they'll go away.

Maybe the owners of the Hollywood trademark are collecting fees from all those entities. On the other hand, "Hollywood" is in such common use in so many ways ("He went Hollywood on us," "It's the Hollywood of France," etc.), it'll be hard to defend.

Mrs. RedShoe works in Childrens animation. She says that in some of the animations the characters went to "Los Angeles" for an episode. Those hollywood people want $25,000 every time that sign is in an animation.

$25,000 and that's just for animation. Needless to say they just didn't animate it into the background. I can only imagine how much it costs for use in movies
